    You are taking the bank to court, you can't expect to turn up at court and say I made a mistake or your case will be thrown out.

    You can amend your claim on MCOL by paying £35, phone them up and find out what you should do.

    We are at the stage of preparing our court bundle and I have also realised a mistake in the charges that we originally put into our spreadsheet. They included interest taken when we were over our overdraft. Can I amend the new spreadsheet being prepared for the bundle, or do I have to stick to the original amount? Obviously this will have changed anyway due to the interest and the length of time that Shabbey have taken in dragging their feet.
    Any advice greatly appreciated.

    You could accept this money on a part payment without prejudice stating in your letter that you are still going ahead with the court for the rest of the money that they owe you.

    My son recently went accidently overdrawn abroad with one Abbey account and got stung with £100 bank charges. He followed Martyn's first step which was to talk to the bank and managed to convince them to drop all charges, bit by bit. He has a very healthy business account with them also which he threatened to withdraw. So please talk especially if it's your 1st time of going overdrawn.

    Hi just spoke to abbey's law team, and they have asked me to email a breakdown off all my charges. I think that I should send they a copy of the letter Abbey sent me saying that the amount of charges I added up is right. I've taken it to court and Abbey put in thir AQ on the 24th of may. Does anyone know what happens next.

    Can anyone tell me what happens after the bank put in their AQ Abbey put theirs in on the 24th May. Took it to court in March 2007
  • Claiming from Abbey and awaiting for court date following defence filed and local court allocated nearly 3 weeks ago. AQ not required but paid the £100. Not panicking as determined to see this through, but if I wrote to ABBEY offering them a chance to settle prior to court would this help my case? Not heard anything from Abbey since receipt of defence.

    Hi All,

    It seems a lot of us our in the same boat.

    I received a letter from Abbey last Friday stating that they intend to defend my claim in full and I can no longer progress the claim through MCOL.

    I don't mind going all the way taking Abbey to court as in 1 month they charged my over £600 worth of bank charges for clearing payments making me overdrawn.

    I have not heard from the court yet asking for my defence, does anyone know what I should put and how long it should be before hearing from the court. MCOL is upto to date

    I sent off my claim a couple of months ago to Abbey (£1275) and after several letters from them apologising for the length of time it was taking I have today received the letter saying that the charges are fair and in accordance with their terms and conditions.
    What should I do next? I am a bit wary of going to court because the account isn't used anymore as I have moved to Natwest but I am still paying off the overdraft through the CCCS which is currently around £800 as part of my DMP. Am I likely to get anything back in these circumstances?
