    Arrogance on the part of the bank. If you wish to reclaim the rest (and I certainly would!), let them know you do not consider the matter closed. Tell them, you will accept this a partial refund and will pursue them for the rest.

    Hi all

    Abbey are dragging their heels again - I sent second letter asking for charges to be repaid on 16th May. Had I not heard a reply I would have started MCOL process tomorrow - I have it all set up on the system. Suddenly I get a letter from them today saying the Abbey credit card account was issued and serviced by MBNA Europe Bank Ltd, and that they have forwarded the letter on! Has anyone else had this?

    I'd be grateful for any advice - I would have thought I could now proceed with MCOL to get my money back; the account was an Abbey one; I don't know what they are talking about. Surely it is still their responsibility to deal with complaints? ! A Strange one; I've looked briefly on this forum and haven't seen any other cases, but maybe I've missed them!

    :mad: evening all I am ruddy fuming:mad: Bl***y Shabbey have stiffed us for our overdraft!! We had a very nice letter back in April telling us that they were reducing it by £400 to £2100, ok fine, we can cope with that, we thought, did all our budgeting and made allowances but the robbing b******* have took the whole flamin lot!!!:mad:
    Rang someone in a call centre who tried to flannel me that it was the original overdraft had expired and they reinstated £1850 (better than nowt I know) but my question is this,how the hell can I get a letter in April, saying only £400 is coming off it then hey presto as soon as my LBA goes (7 days to go Shabbey) for my charges they say the whole lot is expired!! :mad: :mad: :mad:
    I am determined to get my charges back come hell or high water now... they'd better be ready for me in complaints come Monday...

  • Hello, I recieved Notice of issue today from the county court Abbey have untill 18th june to reply. I am now going to get my court bundle together so I dont get in a panic somewhere down the road :rotfl: !

    I have downloaded the court bundle from The consumer action group and will use this but I have to personalise it.

    I have just read a post on this thread and the person said that they used all the letters they had sent, all letters they had recieved in reply and the statments which showed the charges. Is this all that is needed ? should I specify in writing why the charges were made? if you could let me know if anything else is needed I'd be greatful.

    The links for early day motion from the houses of parliment and OFT summary on the court bundle download dont work, where do i go to get these documents??

    oh and by the way Abbey claim to be still investegating my complaint, I also recieved this letter today ( I ignored the initial letter telling me about the complaints procedure) Should I carry on ignoring it and Include this letter in the court bundle?

  • I've just had a letter from the county court with Abbey's reply to my claim and they are defending all of my claim.

    Question: Is this what they usually do???? Is this a tactic from Abbey to delay??

    Given the recent case which went against the claiment this is making me nervous. Any guidance/support welcome!!

    i have finally got a court date for aug 14th,they want copies of all documents 14 days beforehand.
    i need to file with the court a witness statement and they say it must not be a bundle of relevent documents,can anyone tell me what they expect the witness statement to be?
    will i also need to use the court bundle pack from the cag site aswell?

    any help appreciated

    hi all done my mcol with abbey for £1550 was issued they had till 18 june to respond to it but noticed i messed up on my interest bit have now filled out a n224 and n1 form sent them off this morning with £35 postal order so got to wait now till i hear back from courts again with new dates i suppose will keep in touch

    i wouldn't bother contacting abbey since your bundle should be in for 24th june, abbey won't be sending in a bundle so your case should be settled before then.................sit tight abbey will come running now;)

    Notice of Issue Received

    I've received my Notice of issue from the court , the defendant has until the 18th of June to reply, but Abbey have already sent me £600 as a goodwill gesture but I'm continuing with my claim for £1711.00. Do I immediately write to the court and let them know of the part payment?

    Shabbey delays

    I wrote to Shabbey at the beginning of May for £465 + interest. They wrote back saying they would take 4 weeks to investigate, so I thought, okay.

    Got another letter today for another 4 weeks. Rang them up, and they are going over the 8 week limit set by the ombudsman on some cases. I'll write back today giving them 14 days, making an offer for quick settlement.

    They've added another £50 in charges since my letter. Can I include this in my letter, or do I need a separate claim for that?
