    don't let shabby dictate to you,stick to the timescale set out in the template letters.shabbey are just trying to drag it out in the hope that you will just get pi55ed off and give up with the claim

    Thanks, perhaps I will write again and see what I get back!! It isn't a huge amount like some of you guys, but at the end of the day if its £10 or £10 000 it all means the same to us!!

    Started this claim for OH in March.Had a goodwill gesture of £1000 in April.Filed with mcol in May for rest.Had an offer of £1100 on Saturday.They say this is 65% of claim.Decided to accept as we do not expect to be charged nothing when we go overdrawn, we just object to the disproportionate amount.
    But something strange did happen of Monday OH Abbey credit card was withdrawn, they said it was due to a credit reveiw.But we have not had any new credit, no missed payments and no other changes which would affect our credit rating, in fact when he got the card we had 10 cc which were up to the hilt, we now have 2 with a very small balance.So I just beleive it is sour grapes they will get you one way or another.We dont care we were closing it anyway this month.:rotfl: :rotfl: ;)
  • Hi I tried to claim £1400 from Abbey at the beginning of April. They offered me £325 which I refused and told them I wanted all of the charges refunded, they then kept sending me updated letters saying they were looking into this and it would take another 4 weeks. I think they were dragging their heels to see the outcome of the court case that trainee barrister. As soon as that court case was over and he lost I received a letter from Abbey saying they had paid £325 (which I had refused) into my account and are not prepared to pay anymore. Can anyone suggest what I try next.

    Hi, does anyone have any advice - As it seems Abbey are one of the hardest to negotiate with. I've threatened them with court, as gone all the way through procedure and all I've had was the 'sorry you're unhappy we'll investigate' letter. Gave them 2 weeks so will have to start court stuff next week. Any help appreciated!:confused:

    Im really worried now about my case. Wrote to Abbey 4 times over the past 6 months trying to claim back £325 + interest. I file with MCOL back in March 2007. They first acknowledged then defended on the 15/04/07. I got a letter from my local court on Friday saying your court date will be annocened soon & a letter with Abbeys defence. In the letter they have crossed out the part where the allocated questionaire is to be filled and the words,

    ' the filling of an alloctaion questionaire will be dispensed with in this case unless the District Judge at the Court of Transfer orders otherwise'

    To me this is translated into , the judge feels like Abbey are correct in putting in a defence & they case will be heard in court. I really dont want to go to court. If they do not settle, will it go against me if I don't turn up to give my side? I know I can't pull out now. Im getting married in November and can be doing without the extra stress & my hair will be grey soon :-( My 'future husband' nags at me every week, telling me to drop the case (even though Natwest paid £610 out to him!)

    Any help or Kind Words of reassurement would be great.

    Abbey wrote to me approx 2 weeks b4 court hearing settling in full. The funds were available 1 week later. Thats probably the best u will get from them; but i won!

    Relax Greendale; This is the standard letter from the courts. You will more than likely not go to court. This is exactly what Abbey are relying on. People to panic and cancel. I've just won against Abbey and they held out 2 weeks b4 the court hearing was due. even if you have accidently claimed to much you will still probably win, I hope you get an answer soon GOOD LUCK !

    hiya, i applied for my charges back on 16th may..gave 5 days for it to be issued making it 21st may, on the 29th may abbey awknowledged the claim...they now have 28 days to file a defence. but is it 28 days from the date they awknowledged (29th may) or 28 from when it was issed (21st may)?
    sorry i know its confusing!! lol

    My boyfriend is fantastic!! He's offered to lend me the money so that I can finally take my £2800 claim to court stage!! I had no response at all from my second letter and have wanted to take it to the next step for weeks but I'm trying to pay something very important off at the minute so couldn't spare the money.

    Thankfully my OH has stepped in and offered to help me out (he heard on the radio that cases are being settled at a rate of 100 - 1 and that was enough to convince him!).
