When you have not had an offer of settlement and you have sent the 7 day deadline letter - is it better to carry on and get your money back via the Courts or the financial ombudsman?0

i've just heard from the bank - they want to settle for 65% of my claim, rather than go to court. My wife thinks that we should take it as it's over two thousand pounds, i'm not so sure. Could someone advise me whether they think it's worth going for the whole amount or not. They obviously have written saying it's a good will gesture.0

Has anyone had any luck with Inga or Tanya from the claims department at Abbey, I've written a couple of email and they have replied and this was the last email.

I'm claiming for £1,711.00 of which abbey have made an offer of £600.00. I;ve accepted that as part payment without prejudice. I don't know hoe to reply but this is my first draft with a hint of cheekiness:
Abbey have made an offer of £600.00 , I've accepted this as part payment and 'without prejudice' I will continue through the courts to claim the remainder £1,111.00 that is owed, that's not including the stat interest the court would award if I was to win my case. I am happy to continue through the courts and it's really in your interests to improve the offer. I am making a 'goodwill gesture' by entering discussions at this late stage in your interests and also to show the courts I have made every effort to settle out of court.
As far as I'm concerned I will continue through the courts unless you wish to settle a further £1,000.00 and I will accept that as a full and final settlement payment. Should you wish to pursue settlement discussions, please forward a counter offer.
So does anyone think they will be helpful or just try to buy some more time and is the wording ok0 -

I have done most of the bits that you have to do to claim your charges back, got my statments, written the letters to the abbey, got the "thanks for your letter" reply. I have done my "I will take you to court" letter, and had no responce, so was going to start court case today. I have just checked my bank account, and I have £150 worth of £30 and £20's from the abbey today. If this their goodwill gesture?! I have not had a letter with an offer, and £150 doesnt seem right when i am claiming almost £2000. Shall I just carry on with the court thing?0 -
They should have written to you telling you they will deposit the amount. Work out how much they have paid back exactly and write to them to say you will accept this as part payment and without prejudice you will continue through the courts unless within 7 days they can come up with a better offer.
Alternatively you can write that they take the money back and you will not accept at all and you will pursue the claim for the full amount.0 -
I have had a complaint that originally started with Abbey back in Feb, originally just asking for the usual bank charges, since this complaint started I have had various reasons to be dissatisfied with Abbey in general, and back in April decided to close my abbey accounts and go elsewhere, simple enough you would think - but no not for Abbey, they still haven't closed my business account, and are passing more and more charges as I write, this complaint has escalated so far beyond what it started out as, but has now gone to the Ombudsman. Just wanted to know is anyone has had any success with this & Abbey, as I feel I am banging my head against a brick wall - have even written to the Chairman at Abbey. Just keep being bombarded with their usual 4 week response letters, and or ombudsman letters. Someone somewhere is just pressing a button to send standard letters out without READING my complaints. This is SO frustrating - i wouldn't might so much, but half my charges shouldn't have even been charged in the first place!:mad: :mad:0

I Started My Claim With Abbey Back In Jan 07, Recieved A Gogw Of £960 In April (total Amount Was Over £2000), I Sent A Reply Saying I Will Accept This As Part Payment And Seek To Get The Rest.
I Then Had That Standard Letter Saying It Will Be 4 Weeks, Maybe 8 Weeks To Resolve. I Decided To Wait As I Dont Have The Money For Court And The 8 Week Period Is Up Next Tuesday.
Has Any1 Been Successful In Obtaining The Rest After Accepting Gogw As Part Payment????0 -

So glad there is someone out there who won, the thing is, i need to get my court bundle ready now and send it off (i know i have to make 3 copies of everything but do i have to send one to the court, one to Abbey and keep one for myself??)
I have been on the CAG website and puta few posts on but havent had much help to be fair, i have received the court bundle link which is a great help, but at the risk of sounding thick, its very hard to understand!
Do i just need all the correspondance between me and Abbey plus the list of charges? Or do i need anything else?
I would hate to lose on a technicality once i get to court!
Sorry, one more thing. Like the lady who was on the news, i was thinking of contacting my court and asking them to throw the case out knowing that Abbey wont show up, therefore wasting the judges time and also the courts time! There is a word / phrase for this but i cant remember what it is!
Do you think i should do this? If so, how would i go about doing it?
I know this is a bit of a long one but i'm starting to feel a bit out of my depth now with all this legal jargon and am panicking a bit!!:o :eek::eek:
