  • Hi there this is my first post and iam wondering if anyone can help.
    I currently have an Abbey account and have tried twice now unsuccessfully in my local branch to reclaim bank charges(even though they told me i was entitled to them).

    My question is as followed;

    This is a typical example

    fri 13th apr i am charged £20 for going over my overdraft limit (the amount that came out was £8.40) for national insurance.
    On the same day they also charge me £30 for the payment coming out and not having enough funds in the account to cover it.

    So this is now £50 altogether for an £8.40 payment coming out.

    At the time this is all going on i am unaware that i have actually gone over my overdraft so on fri 13th april i use my debit card after the national insurance amount has come out, this payment comes out on monday 16th April they then charge me £30 again.

    This is a recurring occurance which is costing me £80 at a time.

    Can anyone advise whether or not i have grounds to recoup my money.

    Just putting together my court bundle and I have a question - In the letter that I sent the Abbey informing them that I would be taking them to court, there was a paragraph about accepting a lower figure which included the words 'without prejudice' which I understand means that I cant include it in the court bundle. Will it matter that this letter is not included in the court bundle as it is the only one that informs them about taking court action?

    Seems to be a standard response from Abbey according to other posts, I have just sent my 2nd letter requesting my amount back so we'll wait and see what happens.

    In your case, as I understand, you can now move onto stage 5 of the process which is to go to Court or the Financial Ombudsman.

    Details of how to do this are explained along with the template letters although which one you decide to do is up to you.

    Just wondering if anybody out there has successfully reclaimed their charges in the form of a cheque. I am in the process of claiming £1,000 from abbey. Alot of people i know have managed to get money back have had it reimbursed straight into their bank accounts. I have a £1000 overdraft, which if i am sucessfull would be paid off (not a bad thing) but was wanting the cash (if u know what i mean)??

    If there is an outstanding debt with the bank or credit card company involved, which is not covered by a separate contract, they can and probably will offset any charges reclaimed against that debt.

  • Hi everyone,

    Im also at tha last stage with Abbey. I have been asking them to repay around £350 in chraged since Jan 07. The usual has happened, 4 letters from Abbey saying 'I signed an agreement for these charge etc.'

    I filed with MCOL in March, they acknowledge & then defended.


    I rec a letter from my local court on Monday saying the district judge wants a court bundle before the 6th July etc. The wording 'please fill out a return the allocation questionaire enclosed' has been crossed out. Should I give the courts a ring, to find out why I haven't got to fill one out? just worried that this means the judge is in favour of Abbey.


    Also in the court bundle does it have to include the statements & receipt of postage?

    Just really hope Abbey settle soon, It driving me up the wall & causing loads of arguments with my OH.

    Cargo 77, yes this can be reclaimed. As you can see its time consuming and worrying but it has to be done, the fee that Abbey are allowed to charge legally is to cover their costs, and they are not out of pocket for £80 for an £8.40 transgression.

  • I realise I am the only one who can decide ... BUT !

    They have offered 65% of the sum claimed, with no interest and I wouldnt recieve my £80 small claims fee back either ... my gut feeling is take the money and run ... (£474.34 but claiming £729.75 + interest + £80 court fee) .... any thoughts, feelings or advice from anyone who has progressed further than me would be much appreciated !!
