    There will be a further £100 trial fees that you will need to pay to the court which they will ask for once your claim has been transferred to your local court, this of course is recoverable along with your £250.

    Hi everyone,

    I have been reading through the advice given on this thread and it's fantastic, but I have a question to ask...

    I have recieved a letter regarding a good will gesture of £640 from Abbey. My claim is for £1600. I obviously want to go ahead and get the full amount.

    I have written a letter saying that I accept the GOGW as part payment without predudice but will be continuing with my claim.

    But what do I do now? Do I send another letter straight after telling them I'm taking them to court, or do I wait a bit for an acknowledgement of the first letter?

    The account I am claiming for has been closed down because it continues to spiral and is overdrawn by £1,139 at the minute. I would happy with that being paid off. Thing is, I can't even see if the £640 has gone into the account cos I have no cards etc for it anymore.

    Any advice would be amazing, thanks!

    I am taking Abbey National to Court, I started my claim on the 22nd Feb 2007with initial letter, they wrote back after 4 weeks said they were sorry I had made a complaint but they could find no evidence to support my complaint. I wrote again warning I would take them to court, got same letter back. I then decided to go to court through the HMCL site and they entered a defence, it only talks about unauthorised overdraft, but I am claiming back direct debit charges, does this make a difference? At the end it says 'No admissions are made as to the amounts claimed by the Claimant and the Claimant is put to strict proof of the same.' What does that mean? I am mad as hell because it all started off with me being £22 overdrawn and they charged me 11 times in one month. which made me £370 overdrawn for bounced direct debits. Im getting scared now, it seems that Abbey are offering people settlements but getting heavy with me. I have now had a date for a 'directions hearing' in Plymouth on 13th August. Shall I just fold now? It appears this is different to anyone I have read on here. Advice would be appreciated.

    Congrats on your win!!

    I am at the stage where i am just about to submit my court bundle. I am claiming about £2500.

    I need to ask you though, at what stage did you get Abbey offering to settle with you? Did you submit your court bundle before they actually sat up and took notice? My court date is for the 5th sept at St.Helens (not far from you!) but i have to have my court bundle in for the 25th june.

    If you dont receive any response by the time you have given them on your last letter, just file your claim with MCOL (Money Claim on line).

    It sounds like you will have to use the telephone banking line to get your balance and find out if the partial payment has gone in, sometimes it takes a bit of time to go in i believe.
    Keep going though, i did, and am at the court stage now, waiting for my hearing.

    Shabbey will push you to your limit, so expect that and carry on fighting, because in the end, we all win!!

    nearly 2wks after closing date for A/Q received a court date for 29th aug............can see light now;)

    Why have I got to go to a directions hearing, can anyone throw any light on it, it seems to be different than a court hearing, havent been asked for a court bundle or given anything to fill in like some of you have, such as a questionnaire, please help, Im thinking of folding because its a bit scary.

    If you havent got yourself registered on the Consumer action group website yet, then i suggest you do, there is an abundance of info on there that will help you, have a look at this thread below, if you cant just click on it, copy and paste it into your address bar.

    Hope the info on there helps you as it tells you exactly what a directions hearing is and what you need to do. Same with all the other hearings that people may get at our stage!

    Can anybody advise ...

    When filling in the POC and you tell the court of amount claimed to include the interest added to date .... Do I claim interest for each day including Saturdays and Sundays.
