All i would say to people is to READ THOROUGHLY the main article on the site here because it answers a lot of questions in advance for you. and stick to your timescale, i cant stress that enough!! You're in control, not the banks!

I'm also claiming against Abbey, although I'm at the court stage. When I sent my letters off I sent them to 2 Triton Square but replies you get won't always come from that address. Also remember to send mail recorded post so you can check if they received them. Hope this helps

Just to let everybody know that may be interested - I filed at MCOL on 2/5/o07. Abbey came back saying wanted 28 days to prepare defence. That was up on 7th June 2007 and they have not replied to the court so I have now requested a judgement in my favour due to non response. I will let you know how I got on, hopefully it will be straightforward The outstanding amount after addons (court fees and interest since 2/5/07) is £2269.34.

I've sent 2 letters to abbey aka shabby! and have received virtually the same reply to both, saying they are sorry I am unhappy with my account and that they will investigate. They put they need an addition 4 weeks to investigate. This is in reply to the 2 weeks deadline letter I sent to them.
Should I sit tight for 4 weeks and hope for the best, or just wait the two weeks and file online small claims anyway?
The amount I am asking for is not alot, a little over £500 so I was sort of expecting a speedy resolution.
Help, I really need your advice people, thank you for reading and for all your posts previous that have helped me have the courage to go for it!

Do not wait for them to get their act together, they will use all sorts of stalling tactics to try and put you off.
Stick to YOUR time scale not theirs!!
Once their 2 weeks are up, take the next step. With that amount, the cost of filing your claim wont be an arm and a leg, besides, you will get it back when you win.
file your claim with MCOL if that is your next step. Then wait until you hear again. Either from the court or from shabbey!
you have given them ample warning!

Hello all, I'm at the court stage with abbey to reclaim bank charges, the thing is I was checking my statement last week and noticed I had more money than I thought.
There was an extra £220 in my account, after reading my statement there was a number of items that said miscellanious fee refund this was between £20-£35. Does anyone know why they have done this as I'm very confused.

read with interest the success with Shabbey-I have now receied a GWG of £1278 against a claim of £14000+ without interest, so a partial ictory but I hae the bit between my teeth and want my money bank- so I guess I write without predjudice etc do I give them any more time or just go to MCOL now?

Its them trying to soften you up!
How much was your original claim for, if it is more than the £220 then I would send them a letter saying that whilst you accept this partial payment without prejudice you will still continue with your claim until they meet the full amount. In the meantime I would start the procedures with MCOL they will soon realise you mean business, this has happened to quite a few people on here, sadly Im not one of them

In that case write them a letter saying you arent accepting it & ask why its there when your claim is for £2855, Id also phone & tell them the same, get a name etc of whoever you speak to. If you're already at this stage Id take em to the wire!! :TOfficial DFW Member 587 :T0
