Abbey acknowledged my claim and they had 18th June (today) to submit their defence. What happens if I don't hear anything in the next day or 2, how do I enter a judgement by default, what usually happens at this stage.
Also 'without prejudice' what does this actually mean?
I received a payment of £600 (total amount claim £1,711.00) just after I filed a claim through the county court. I accepted and also let the court know of the payment, is that ok?

When filling in the POC and you tell the court of amount claimed to include the interest added to date .... Do I claim interest for each day including Saturdays and Sundays.

You are unlikely yo get judgement by default as the bank will no doubt enter a defence at the last possible minuteThis is not the 28th day!!! If your claim is on-line (@ MCOL) then they get about 5 days extra to allow for delays in the post etc, also if the last day falls on a weekend they get till the next working day, but even then you have to allow for the court to open their post and enter it on the system.
If its at your local court, you will need to contact them directly but the same timings may still apply.
err Just a quick question here - Did you accept payment but still expecting judgement by default? or is this a different claim? I accepted it as part payment na dwrote will continue through the courts for the full amount, claimed via local court in person. Abbey said they were going to defend and had 18th june to submit paperwork/particulars of claim, i might be jumping the gun as it may be in today's post.0 -
Hi all, I hope anyone can give me advice.
I lost my husband 18 mths ago. The mortgage, house, where in his name. I obtained probate. It is with the abbey. I have since got into mortgage arrears.
I contacted the financial ombusman back in feb to reclaim bank charges with the abbey. I was offered £150.00 which i refused. The abbey wrote to me, to say that the would look into it again. That was the beginning of April. Since then I have heard nothin. I sent them a letter. 4 weeks ago with copies of statements showing charges dating back 6 years. requesting nearly £4000. this account was a joint account. obviously it isnt anymore.
I have spoke to the abbey, this morning who have told me. I have been declined, with no gesture of goodwill. Is that it. do you think my other circumstances are anything to do with this. Can anyone please help me. I dont know what to do next.
I was banking on this to pay mortgage arrears off. Also I have still not transferred the mortgage into my name. As i can not afford solicitors fees, and the mortgage transfer fees that go with this. Im a single mum please can anyone advise what to do next.

I am claiming for Credit Card charges off Abbey at the moment. I have received the statements and have done the 1st letter and printed off the Interest Calculations.
Should I send this letter to the registered address at Triton House or the local branch where I live, even though I have never used a local branch.

Thanks LozBingley for the info ..... but r u sure about the rate per day. i do not want to split hairs, but I looked on a previous thread (which included template for the POC) and it quotes .00022 per day.0

Right Team,
We have had a reply from Abbey from the letter I sent on 11 April 2007, asking for £1741 in charges, and guess what?? yep not a hope. They have offered us £623, which includes the cancellation of charges yet to be taken from the account, now when did they put this money into the account? the day the next lot of charges where due out of the account, so we didn't see any benefit from them at all. :mad: :mad: :mad:
My wife is now so peed off that she is now behind me 100% to take this further.
Now I believe the next step is to send them another a letter accepting what??
I suppose I have to work out what was refunded and what was a cancellation of "charges yet to be taken from the account"??
