my GOGW was £460 but £440 was actually deposited into my account so all i did was
delete £440 of the most recent charges off my list.........so i should think the same applies to you.......i didn't bother with the "charges yet to be taken from the account" bit.

I am claiming just over £3000 from Abbey and have been given a GWG of £1098!!! £350 of which was for charges not on my claim letter or due to come out later in the month so they've actually only offered me a third of what I'm asking. I rang the number on top of the offer letter this morning and was told that the GWG stands but I have to go to a final stage (or something) if I want to argue it. Which they say could take a further 6 weeks!!!! I would take it to MCOL but seeing as though they cancelled my overdraft when I started this claim, the money they've paid in today goes to pay that off and leaves me with £120 !!!!!!!!
So miffed but hopefully we'll get there in the end!!!:mad: :mad: :mad:So far:-

Help!
I've sent 2 letters to abbey aka shabby! and have received virtually the same reply to both, saying they are sorry I am unhappy with my account and that they will investigate. They put they need an addition 4 weeks to investigate. This is in reply to the 2 weeks deadline letter I sent to them.
Should I sit tight for 4 weeks and hope for the best, or just wait the two weeks and file online small claims anyway?
The amount I am asking for is not alot, a little over £500 so I was sort of expecting a speedy resolution.
Help, I really need your advice people, thank you for reading and for all your posts previous that have helped me have the courage to go for it!0 -

One question I would like to ask is this:
If I dont get the info I want can I make an estimated claim based on the figures I already have? How long after the complaint to the ICO do I wait before I take further action, and what action can I take?

Well they have had their chance.
I filed a claim for £2379.21 inc interest and fees with MCOL on Friday and have just seen that it was Issued yesterday 18th.
I guess I just need to wait and see if they file a defence by 7th July.0 -
We have sent off the statement with the details of the charges we want to claim back and the interest on top and have since received a letter from Abbey saying they have assigned a caseworker to 'look into' the situation and will get back to us. Yesterday we received another letter saying they were still looking into it but needed more time (why we don't know)! Has anyone else had this problem of them buying time or does anyone have any tips for how to stop them doing it?

I started with my claim in january 07 and followed all the stages as advised on this website.
Abbey defended their claim in full when i filed a claim for approx £2700.
They sent me a GOGW of £120 which i accepted as partial payment without prejudice, but still carried on waiting for my court date which arrived for the 5th Sept 07 and i had to have my court bundle in for 25th june 07.
Got their letter this morning offering to settle in full!!
The say the following:
"Abbey is raising a cheque for the sun of £2943.41 that will be paid into your account (if open) or posted to you. We will now inform the court that Abbey is settling your matter in full and asking the court to withdraw the claim from the hearing list. Once you have received full payment, would you please inform the court that you withdraw your claim, and provide us with a copy of your letter."
So, to ALL of you who are either losing faith or are having Abbey play games to prolong the fight, keep going!!! You will get there in the end!
and thankyou so much to those of you who have helped me over the last few months on here, your advice has been brilliant!
I will keep checking in from time to time and i will try and return the favour in whatever way i can.

P.S. From what i realise, abbey probably wont settle unless you have a court date, so i'm afraid it is going to cost people a bit to file a claim, but dont worry, when they settle, you will get it back!!
So dont let them grind you down!!
