I have just started my MCOL and emailed Abbey to let them know that I'm now expecting a refund of interest and court costs. etc.... Abbey did offer 455.00 as full and final settlement. I replied I was happy to accept as part payment to the 2 grand I'm claiming for. Hopefully this won't drag on as could really do with the money!0

Claiming on behalf of my sister. When I sent the first letter she got a reply saying that they were looking into her complaint and would like four weeks. Sent the 2nd leter threatening court action, and she got a letter asking for another four weeks and then a separate letter saying no way. In the meantime, they've charged her more. I'm going to advise her to make a phone call asking for the original amount plus the additional charges and follow that up with a final letter and then court action.:dance: Proud to be dealing with my debts0 -
If I've said it once I've said it 101 times. You are all wasting your time trying to reclaim your charges unless you go to court. It's a simple equation -
Don't go to court = the banks will mess you around and fob you off (and also laugh at how niave you are).
If you want 100% of your money back then you MUST take them to court AND hold out till the end, then 99% of the time they will pay up. If you are not willing or are scared to take them to court do a) nothing or b) use one of the reclaim companies who take about 25% or sometimes even more.
Of course though you do have to start writing them the standard letters before taking them to court but once they have either ignored you, made a crazy offer or said they 'take compliants very seriously and will be back to you within 4 weeks' don't play their games play yours which is to file with the court.
I have won countless cases for myself and friends doing the above but if I was wishy/washy about it then I'd still be wondering where my money is.
Don't mean to be harsh but many of you need to toughen up otherwise as is the case, the banks will continue to walk all over you.

Evening all,
Right about three weeks ago i sent a letter to ABBEY saying i would accept £853 of " goodwill gesture " money as part payment only.
I sent the letter by recorded post too, so i know they have recieved it !!
So now it looks like its court action time.
Can anyone suggest which is the best way to do this as i'm not to sure,
also is this an easy step to do ?? I have not a clue,but i am determined to fight for my money even if i lose in court and look like a fool. lol.
any help would be much appreciated.0 -

thought i would share my succes with you as an encouragement for those still going through the process. I have followed religiously the advice given on here and was due in court this friday. Abbey have just settled my entire claim £1.760. plus all cost's.
I'm absolutely thrilled. For all of you filled with doubt and trepidation, don't be. Plough on and you will be rewarded.
Thanks to all who have provided advice to me over the last 3 months.0 -

I now want to involve the ICO but need proof of when my cheque was cashed. I'm stuck without this evidence and cannot move to letter 2 till I get my statements. Help! How can I get out of this 'catch 22' situation?

abbey took around 5-6 weeks to send my statements which i paid for with a postal order. when they came through they also sent a letter of apology for the time it took and refunded the £10 striaght into my account!:rotfl: :rotfl:

See, Sal 'ploughs' away at the process AND takes them to court and gets a result. If he/she had not taken them to court there would be no result apart from perhaps a letter from the bank offering a £350 settlement.
