    Hi

    Yes I had already applied to the courts online £ 120.00, then I got another letter from the Courts requesting an Allocation Fee £ 100.00, and a court date for the 22nd June, I didn't expect to hear from the Abbey until nearer the date, if at all, but then out of the blue they phoned and then settled.... Take it all the way and be confident, it really will not get to court.....;)

    HI ALL YOU BRAVE POEPLE FIGHTING BACK AT THE BANKS I JUST WANTED TO ASK FOR SOME HELP BECAUSE I HAVE SENT THE BANK(ABBEY) MY SECOND LETTER OF WARNING AND THEY HAVE REPLYED TO MY SECOND LETTER(NOT MY FIRST) THEY SAY THEY WILL REPLY TO MY COMPLAINT WITHIN 4 WEEKS! WHAT SHOULD I DO ITS REALLY WORRING ME THAT I MIGHT NOT GET MY MONEY BACK AND I CANT AFFORD TO GO TO COURT HEEEEEEELLLLLLPPPP :confused:

    they are just stalling for time,coz in four weeks time they will probably send you another letter saying they need another four weeks!!! Thats what they did to me and quite alot of other people on here! I would carry on with the court letter, and stick to your time scale. Also read MCOL about payment i think there are some reason where you don't have to pay to take them to court, anyway you claim it back of abbey in court!!

    I have been pursuing my claim in the correct manner this last few weeks. I have had letters off Abbey right on the 14th day each time asking me to wait 4 weeks while they investigate my "complaint". But before I could start the court process,I got a letter last Friday saying they are prepared to give me £963 and it would be payed into my account within 10 days. Well on the same day they deposited £680. My claim was £2500.

    My question...can I still take them to court for the full amount and if so what letter template do I use? Also, I have spent some of the money already,does that matter? They didnt give me a choice,as I would have refused the £963 if they had.

    can anyone tell me if this is correct.
    No. 1 --- send second letter asking for money back (ignore reply asking for 4 weeks to sort it out)
    No. 2 --- after the 14 days send letter warning bank with court action
    No. 3 --- after th 14 days Fill in the N1 form or mcol

  • I have bank charges to the ammount of 770 pounds.
    Have followed the procedures to claim the amount back, I was offered
    210 pounds by the abbey as a good will gesture!

    I was informed the money would be placed into my account on the 19th May
    which gave me enough time to decline the offer.

    I have just checked my balance and the good will gesture has been already credited to my account.

    I have already recorded a letter (which was sent today) to the abbey, declining the offer and stating i wish to pursue the full amount.

    Please could anyone lend some advise on what my next step should be.

    Do I send another letter asking them to remove the good will funds?

    Will this effect the claim process?

    Hi - I decided to send in the letter including interest.... £1135 in total from Abbey which is a closed account now and has been for the past year.. would it make a difference? could any one tell me

    Hi I just wanted to email to say the same thing has happended to so you are not alone!!! But i have already started the court proceedings!

    They (Abbey National) owe me about £1500, and offered to pay back £500! They said they would pay it into my bank within 10 working days, The letter they sent me arrived Thursday May 10th but it was dated 30 April! So it gave me two days!!! (because of weekend) I wrote back declining it and said i want the full amount. However i have just looked at my account and they have paid me £250? So i am going to draw it out and write a letter to the court showing their letter, my letter etc, as apparantly they are not allowed to do this.

    I would write a letter back declining it!

    I hope i have been of some help, but i am the same i'm not to sure what to do either!!!
