    Hi...

Does Anyone Know If Anybody Has Lost A Bank Charge Claim ???? And What Happens If You Do Loose ??
The " Shabby " Has Just Sent Me A Copy Of Their Defence At It Looks So "legal" And Complicated, I Felt Nervous About The Whole Thing Before And Now I Feel Petrified !!

Please Someone Tell Me I Am Doing The Right Thing In Taking Them On.....
    Broke

    Hi broke
I'm at the same stage as you, recieved abbeys defence last week, and from what a can see abbey are sending everyone the same defence! I was like you being nervous about it all, now i'm at the court stage i'm petrified! But i know they have £2500 of mine and that tells me i'm doing the right thing taking them to court!! And so are you....keep going it will be worth it in the end!

  • Hi
i would personally start the court line because abbey seem to be doing nothing for you!! Except keep you holding on. I started the court procedure in march, abbey haven't contacted me at all only to say their sorry about me being unhappy!! They seem to be offering people goodwill gestures, but i've had nothing!! We now have a court date of august 14th but the man from the court said they will probsbly settle before that comes!!
So good luck with whichever you choose!!

Tks for the reply Kim, yes your right they are stalling, have decided today to go for the court option, if they can only charge me £10 for 37 sheets of statements spanning 6 years, how can they justify a £32 charge for a computerised letter.
Will let you all know how I get on.

I sent my mums initial letter off 2.5 weeks ago, recorded. It isn't even showing as delivered online. Anyone else had this problem?

If so, you've had the same problem as me on three letters sent in the last month. Although I can see the date of delivery on their website, there is no scan of the signature available.

Does anyone know if the bank can weasel out of acknowledging receipt of my letters if I cannot produce a signature, in court for instance?

Just make sure you stick to your timescale and not shabbeys!!!

Some email address i used are:
    jackie.scott@abbey.com
    debbie.waghorn@abbey.com
    customerservices@abbey.com

dont count on a reply but do keep annoying them!!

    GOOD LUCK

That's great - thanks for the email addresses. I've already tried now via complaints form on abbey website; don't expect to get a reply so if not I will try these emai addresses very soon, and if nothing by middle of the week I'm going to try via the ICO website and see if they kick abbey's !!!. As I have recorded delivery slip I will use that date as beginning of my claim; you're right; it is to my timescale; I have proof I wrote for the statements on 15th March!!

HI, I am sending my 3rd letter off to Abbey. Which court address do I put in? Is it my local court (Carmarthen)?

    hi pink_phantom
yes, you put your own local court, the papers that come back will probably say Northampton Court, but don't worry everyones so far has said that, once abbey put in their defence it gets transferred to your local court.
    Good luck!!

As I have already said to you, the court and/or the banks solicitor will contact you as to what happens next and send you any forms you may need to fill in.

I'm not sure where you have got this "send in the balliffs" from, you need to win your case before you do that :)
