    Hi all…

Well I was about to email Jackie at abbey again this morning when the postie arrived…you guessed it with my remaining statements yay so anyway I had a look through them quickly and I don’t really understand many of the abbreviations – I know VP seems to be payment in shops, csh is cash, trf – transfer , bgc – bank giro etc.

I only seem to have 2 unauth o/d fee one for £15.00 and one for £16.50? These are ok to claim right?

Also what is INT Debit IDB? Can these be claimed (the biggest one on my statements is about 5.99)

Sorry if this sounds stupid lol

    Any help is much appreciated

Ok this may help may not but it certainley helped me, after requesting my statments for over 80 days i finally got hold of a email address for someone who works in the data protection side of abbey, i emailed her to tell her how discrased i was of how i was being treated and how they were in breach i that i demanded my statments in the post asap or i would be reporting them to ico tonight online, any way at first she replied saying it has been passed to bradford office to investigate, i replied demanding when i will receive or if i dont have a answer by end of today i will be filing the complaint to ico office, i know i was pushy but well i think you need to be now, well it worked i received email same day to say statements were in post that evening and i received 2 days later starting from 2001 !! :j you will need to keep emailing all day for updates and be a pest basically hope this helps good luck im now claiming my £518  hopefully the ball has started rolling now

Oh dear hs anyone else had this. I have an £3300 overdraft and although I do have a parachute account set up but it really doesn't meet my needs. I am claiming 896 + interest so no-where near the od so paying the OD back would cripple me financially. I have not had an OD review in at least 3 years. Have many others had this and is there a route for complaining if they do. However the damage having the 3300 snatched away will not be compensated by complaining.

I was going to post my letter today but.........

Sounds like another delaying tactic to me?

From what I've read I wouldn't worry about it. Just because they submit a defence doesn't mean they'll turn up in court. Even if they do, just read the posts here and you'll get plenty of info.

Letter sent today requesting payment of charges. £3578.00 and with interest £4299.55.

Already have a letter from Abbey telling me they can;t reduce my overdraft (tried to the other month) until 01st July so will be interesting if they try and do anything to it before then!

For people new or just starting, please take the time to read all of the posts on here as you will usually find your question has already been answered. I realise it takes agaes but a lot of that is because people have been asking the same questions over and over.

To all those who have succeeded and/or are giving out great advice, thank you!

    Hi,

You're not alone, it must be the day for Abbey Defences - just received mine in the post too but not from the court from Abbey themselves???? and really don't know where i go next - need help aswell!!!

I recieved abbeys defence last friday and from what i can tell most people are getting the same papers!! Also i think Abbey are messing with my account coz on tuesday i noticed they didn't pay a standing order to another account, when i went to ask why it wasnt paid, they said there was a general sop on my account???? But nobody could find out why it was put on in the first place, and they phoned up quite a few people!! In the end they took it off (the general Stop) and i had to manually take the money out to put into another account!! what a pain in the a***!! So its all a mystery!

Standard reply, just a bit nicer than the ones usually reported on this site. They were ever so nice to me about sending my 6 years details too. The banks are allowed 8 weeks to respond to and deal with a customers complaint as per the guidelines laid down by the FSA. This is only relevant to you if you intend to use the Financial Ombudsman as you would be required to exhaust the banks complaints procedure first.

As you are using the court route with the process laid out in the main article with its template letters and timescales then there is no requirement to follow the banks complaints procedure. You need only show to the court that you have allowed ample time for them to respond to and deal with your claim.

Its up to you if you wish to wait for them deal with your 'complaint' but you dont have to and can send your next letter. Good luck :)

Have done all that procedure and must admit Abbey have been very prompt in replying to me. Had a letter back today saying they'd investigated my claim and that the charges were applied correctly and as I had insufficent funds at the time, they are then unable to agree to refund any further ( I have never had any refunds of them).
Have also been sent bump on there charges and "another" how to complain leaflet and told I can take my claim to the FSO and if they don't hear from me within 8 weeks they will close my file.
This seems to be a standard letter signed by a Eamonn McFaddon, Senior Customer Resolutions Manager, there are things in it that I have not asked for ie. asking for any default notices against me to be removed. Also was told to ensure there is sufficient money in my account to cover DD and other payments. I have not used this account for 2 years so it shows how much investigating they have done.
The problem I now have is wether I should go to the FSO or claim in the courts, I would appreciate a reply from someone on this, as have posted before and there has been nothing forthcoming.
I also have the address of the Abbey legal department, where claims to the court are sent if anyone's interested.
Will let you know how I get on.
