    If I was you I would write to them and threaten them with court action. I think even then you'll find with abbey that they will either ignore your letter, or give you a pathetic 'goodwill gesture'. You will most probably end up filing on MCCOL and getting them to pay up that way. There are loads of people who have been and are in your situation so go for it. There are so many kind people here that will give you advice and guide you along the way. Good luck and go for it.

    You're right about Abbey ignoring complaints, they seem to be notoriously slow! Anyway I think I will go down the court route. I guess if I do win then they will just take the £585 from the final amount.

    hi i sent of the first letter on 11/04/07 asking for my charges to be paid back toayling £1186.00 £1302 with intrest usual reply 4 weeks blah blah ........
    sent the second letter 26/04/07 threating court action no reply incurred a further £140.00 in charges
    emailed abbey telling then 7 days or court action
    what now????????
    cant really afford the £120.00 court fee as i'm due anothe £140.00 this month due to the charge last month help !!!!

    Ok this may help may not but it certainley helped me, after requesting my statments for over 80 days i finally got hold of a email address for someone who works in the data protection side of abbey, i emailed her to tell her how discrased i was of how i was being treated and how they were in breach i that i demanded my statments in the post asap or i would be reporting them to ico tonight online, any way at first she replied saying it has been passed to bradford office to investigate, i replied demanding when i will receive or if i dont have a answer by end of today i will be filing the complaint to ico office, i know i was pushy but well i think you need to be now, well it worked i received email same day to say statements were in post that evening and i received 2 days later starting from 2001 !! :j you will need to keep emailing all day for updates and be a pest basically hope this helps good luck im now claiming my £518 :rolleyes: hopefully the ball has started rolling now

    Ok i have been reading the forums and the advice.

    I have sent abbey my first letter with spread sheet of charges

    Charges £2674
    Interest £705.87
    TOTAL £3379.87

    Recieved letter from them 24th April

    Basically saying they are sorry i have been un happy ( yeah right)

    The last paragraph how ever " Although i do not know what the outcome will be, I do hope that we will be able to find a solution that you are happy with"

    they estimated four weeks for a result

    What do you think is this a standard keep me waiting letter or is this something different ?????

    Any comments would be very much appreciated

    Hi emmaessex,

    I tried emailing Jackie Scott and she didnt bother to emial me back!!!

    I was thinking of emailing again to say how disgraced i am and that they can rest assure my complaint to the IC will be sent out ASAP and that i will also report them to my local court.

    They have kept me waiting 78 days now and its driving me mad!!!! :(

    I just dont know how to write it in a way that
    a they will take notice and
    b make the email sound like i know what im talking about lol

    Any ideas?

    Would be VERY MUCH appreciated!!

    I also have been emailing jackie.scott@abbey.com chasing my bank statements but had no response from her. :mad: But finally today after 71 days I have received the lists of charges so I will be getting my request for refund sent out by Recorded delivery tomorrow. ;)
    I have already made an official complaint to the Information Commissioner about Abbey's long delays and not complying with the SAR.

    this is what i emailed to Abbey but whether they actually took any notice of it or it was just a coincidence that the statements turned up shortly after, who knows?!

    I still await a reponse to my email dated 1st May 2007 regarding the Subject Access Request originally made to Abbey on 1st March 2007 for all default charges debited to my Abbey account over the last six years.
    I appreciate that you are probably very busy and being inundated with similar requests but under the Data Protection Act 1998 Abbey are obliged to supply me with this information within 40 days and this has not been complied with and all my correspondence by telephone, email and letter have been ignored.
    I have been left with no alternative now than to report this breach to the Information Commissioner and FSO unless I have received a satisfactory reponse before all the necessary paperwork is dispatched at the end of the today.

    I've never seen anything as amicable as the last paragraph you quote. Certainly not from Abbey. Could they be softening? How do they quote four weeks for a settlement? That's ceratinly not the norm for them.

    Disagree with Camdenite (sorry) :)

    I'm wating for a court date with Abbey, (they have lodge dtheir defence at County Court) and the above letter is like the standard ones I got ...

    Sorry you had a complaint .. (yeah right!)

    Looking into it ... (yeah right!) May take 4 weeks, maybe more ... (bet you anything it's more!) and you'll get a worthless letter back saying that theyve found nothing wrong / or the charges were correct as laid out in the terms and conditions etc ...

    Martin has a nice anaolgy on that .. as in if some tells you they're going to punch you, and then they do, that doesn't make it legal. The same applies with their charges.

    The important think I think is STICK RIGIDLY to YOUR timescales... not theirs, as they will take forever to do absolutely nothing ...
