Can anyone help please?
Im at the court stage and got a defence through from Abbey.Should i be worried or will they settle up soon?:beer:0 -
From what I've read on the forums, don't worry about it. Even if Abbey don't settle before the court date they won't turn up. You then put the case to the judge saying you feel £2.50 is a fair charge, he'll agree, and in come the bailiff's to pick up your cheque.
I'm taking Abbey to court and have just rang the court who say they've issued the claim today. It does seem to be taking forever!0 -

Received a letter from my local court today. My hearing will take place on 4th June and will last for approx an hour!! Got to get my head round all the legal jargon and sort out my court bundle. Getting quite nervous about it all now. :eek: :eek:0

My claim with Abbey has been acknowledged and they have until 22nd of May to put a defence in. From what I've read here I expect them to do that on the day. Let us know how you get on and I wish you the best of luck with your claim. There is a good chance they will settle before actually going to court though. I know it will get settled before it goes to court but what if they decide to actually go to court - I'm petrified that they will!! I don't know how I'll cope if I have to actually appear in front of everyone!! I think I'll feel more settled once I've got my court bundle sorted out and sent off - that's my job for this weekend!! lol :rotfl:

There is loads of info on the CAG website regarding court bundles as well. Don't worry about the court. From what I've read on this website and the CAG website the banks don't turn up, and the judges seem to be on our side not the bank's. But I know what you mean it's scary, you'll feel more confident when you get all your info together.January GC £38.35/£1500 -

I would go to court for the money. I'm still waiting on lists of charges for 2001, 2002, 2003 and each time I contact them I'm told something different. These clowns will stall at every opportunity. Until you file with the court they won't think you're serious and will think they have the upper hand - which at the moment they have as they're in possession of YOUR money!0 -

Really you should have submitted that LBA 7 weeks ago (assuming you already had your statements at the start of the 9 weeks you mentioned).
Prelim letter - 14 days
LBA - 14 Days
Court Claim - 14 days
Acknowledgement of Service - 14 days
Submission of defence - 14 days
The rest is in the lap of the gods, how busy your particular court is etc.Hamsters have no tact and diplomacy, nor do they want any.0
