  • hi all
just spoken to someone in the court at cardiff, and he says not to worry if going to court, i wont have to talk because the judge will look at the papers and decide there and then, so most of them have been for the claimant!
The court dates are going out this saturday, and he says usually as soon as the banks get these they start settling up out of court, so with any luck i might get my money soon! this has been going on since january!!
    Good luck to every one!

Hi there can anyone help.My OH is in the process of reclaiming his bank charges from Abbey. He has had approx £715 returned in March and has filed with MCOL for the rest £1750.When he had the first amount refunded Abbey never touched his overdraft £1200 and said they wouldnt, hence he never opened a parachute account. He gets paid today and iv checked on line for him and his account is showing as £885 overdrawn and no money available even though his wages of £300 has been paid in.Can they reduce the overdraft without informing him first.I feel sick we have 2 children one is a 5 month old baby, I dont know how we will manage we dont have any money at all now.Can they do this without warning?
  • I forgot to ask, but does anyone know the phoe number to ring to see if abbey will negotiate??

    thanks, Kim

I thought they had to give you 28 days notice. according to their t&c's "we will wherever possible give you at least 28 days notice", ring them up and ask them to confirm your OH overdraft limit, as they did this to someone else on the CAG forum and they reckoned there was just some sort of error.

I have just rung them and the lady at the call centre said they were having some problems, couldnt go any further as the account is OHs.I have rung him at work and he said a lot of people with abbey accounts havnt been paid, he has been paid but it isnt available looks like OD has been reduced instead.Iv checked his last statement and it says the OD limit was £1200 he only filed with mcol on monday so I dont think that has affected it.Il have to wait until he comes home and he can phone them and sort it out.I feel a bit better now, I had visions of my children starving! Although if it is their mistake we had dd coming out for which we will now be charged.

    Hi Guys&Girls ;)

Im in the process of trying to claim back my charges from the worst banks abbey and natwest, i've followed all the letters and now have to go to court Ive not sent the court letter yet and was wondering if there was any cheaper way of doing it other than mcol as I cant afford the £100 ish to start the claim. Can it be done manually through the small claims would this work out any cheaper. anybody in the same boat as me? Ive no response im so fed up with it now its been going on since feb and march, funny there quick to take but not to give  , nothing i do seems to work, letters, phone calls. even sent a email to abbey through their web site as a complaint, sent 100 emails kept pressing send, send etc, still get fobbed off why wont they listen!!! god I hate banks!!! please can somebody help? be good to hear anybody in the same boat as me :o

Hi there can anyone out there help?

I wrote to Abbey back in March requesting my bank charges of £2500 + interest to be paid back. I took the slightly softer approach of threatening to report them to the financial ombudsman rather then going down the 14-day court route. Anyway finally they have written back to me offering me £585. Whilst this is quite a bit of money it's only a fraction of what I'm trying to claim.

My question is am I best off writing back to them saying that I will not accept their offer and change tact by going down the 14-day court route, or should I complain directly to the financial ombudsman?

Any advice would be greatly appreciated.

    Many thanks,

They did that last week to our account, husbands wages went in (showed up on the online banking) but took until 1pm to show what we could physically take out the bank.

Glad you got it sorted, less stress for you.
