    Also have a read of the post about interest by Rex Mundi in the Reclaim Help Thread which is linked in my signature as this explains the interest you can claim if you can prove that the bank interest was charged due purely to bank charges.

    The main thing is if you have included interest in your claim and you receive an offer of the full amount without interest from the bank BEFORE you file at court or online you must accept this offer.

    Thank you Lass. Yes I got the contractural and 8% interest confused. I did know it was a bargaining tool in the early stages and would have to accept claim in full if offered without it. I then got confused by the talk of interest on charges as they had made people overdrawn etc.

    Re-reading it I am now clearer and will leave them in my letter and get it in post tomorrow.

    it might be a idea to ask jackie for a manager call back as it seems abbey really do noy like giving these out, in one of my emails i advised her that if my statements were not sent today then i want a manager call back today also advice her that you are keeping all correspondance that you are sending and receiving to send to ico office unless you have a answer by today, you have waited long enough !! good luck hogo and please keep me posted

    Hugo this is the email i sent

    Firstly i must point out how appalled i am with Abbey and dissapointed i am to be treated so unfairly when i have been a customer for a very long time, customer service is not customer service as they to are not giving me any information to my complaint i am at this point very very angry and want my information in the post today or i will most definatley be taking legal action as this is just not fair at all.

    As stated in my letter on 23rd April 2007 regarding outstanding information that you have failed to send to me under the Data Protection Act 1998, (your 40 day deadline under the Act expired on 12 April 2007 it is now 3 May !! I have also given you extra time ( lots ) in which to comply), and despite various letters and a phone call on 27th April 2007 you have failed to contact me or send me the information I requested.

    I appreciate that your department is probably busy due to the influx of recent claims, however you still have a duty under the DPA 1998 to comply within the prescribed 40 days and you have not done this.

    As per the Data Protection Act 1998 (Part II Rights of Data Subjects and Others), Section 7(8) states "a data controller shall comply with a request under this section promptly and in any event before the end of the prescribed period beginning with the relevant day"

    I have also informed you of my complaint to the information commishioners office and ill also be contacting the financial ombudsman
    I look forward to a response from you today either by phone or email if you wish to discuss this, before the form/bundle are delivered via recorded delivery to the parties mentioned

    Please note that i have given you reasonable time and we are now approaching 80 days of waiting for my statements and this is just not reasonable i have already filed a complaint to the information commisioner and will update them with the letter that was sent to me by abbey on the 17th April teling me my statement will be with me shortley and also the letter dated 27th april 2007 saying statements are on the way but i still have nothing i trust this matter will be sorted today and i await a email or phonecall. I will be saving all correspondance that i send and receive to send to the ICO and ombudsman

    Hi Jackie thankyou for replying so quick its much appreciated, could you please give me a timescale as to when i will be receiving a responce to my complaint regarding receiving my statements as i seem to be waiting more then anyone else i have spoken to if you cannot give me a timescale then im requesting a manager call back today please, could you confirm to me that i will receive a manager call back unless someone can tell me today when my statements 2001 - 2003 have been sent, i have a newborn baby so please understand i really dont have the time to keep sending letters and emails its costing me money and valuable time

    sent a 3rd email asking where my manager call back was and advised if did not receive a call then would be filing new complaint for being ignored !!

    Ok i have been reading the forums and the advice.

    I have sent abbey my first letter with spread sheet of charges

    Charges £2674
    Interest £705.87
    TOTAL £3379.87

    Recieved letter from them 24th April

    Basically saying they are sorry i have been un happy ( yeah right)

    The last paragraph how ever " Although i do not know what the outcome will be, I do hope that we will be able to find a solution that you are happy with"

    they estimated four weeks for a result

    What do you think is this a standard keep me waiting letter or is this something different ?????

    Any comments would be very much appreciated

    Standard reply, just a bit nicer than the ones usually reported on this site. They were ever so nice to me about sending my 6 years details too. The banks are allowed 8 weeks to respond to and deal with a customers complaint as per the guidelines laid down by the FSA. This is only relevant to you if you intend to use the Financial Ombudsman as you would be required to exhaust the banks complaints procedure first.

    As you are using the court route with the process laid out in the main article with its template letters and timescales then there is no requirement to follow the banks complaints procedure. You need only show to the court that you have allowed ample time for them to respond to and deal with your claim.

    Its up to you if you wish to wait for them deal with your 'complaint' but you dont have to and can send your next letter. Good luck :)

    Has anyone got their money back from Abbey without going through MCOL but just waiting it out??

    Abbey - £2995 claimed, offered £1098, accepted as part payment and proceed to next stage, response not satisfactory so currently with Ombudsman:confused:

    Cap 1 - settled on charge difference:j

    Barclaycard - settled on charge difference:j

    MBNA - 1 account settled in full, £993:beer:
    - 2nd account settled on difference:T

    HSBC Visa - no charges amazingly!!:rotfl:

    Household Bank Visa - settled on charge difference:T

    ACE catalogue - settled in full after 1 letter!!!:beer:

    hello, back in february i reclaimed bank charges mounting to £4670!! on the 22nd april they gave me £625 back (not good enough!!!!!!). so i took it to the financial ombudsman. today i recieved a letter from them telling me their procedures, and it stated it may take 6 to 9 months to get a result. i really dont want it to take that long, i think its took long enough!!!! can i still take them to court even though i have gone to the ombudsman, or do i have to wait for them to resolve the case. how do i go about getting a court case and how long will it take through the courts????? im getting very frustrated with all this waiting!!!!

    :money: hi, abbey has sent there defence and now the court has send me there defence papers.
    what do i do now?
    they say they are not going to pay me
    and that the carges are correcrt they are going on about overdrafts i didnt have one....
    what do i do now
    do i contact the courts or bailliffs?

    You're not alone, it must be the day for Abbey Defences - just received mine in the post too but not from the court from Abbey themselves???? and really don't know where i go next - need help aswell!!!

    I have been charged to for an overdraft which i dont have , looks like we are in the same boat.
    I phoned them today stateing the law and they have wavered the £10 fee , and insisted i will have my paperwork in the next 7 to 14 days .

    hi all taking on the abbey. just thought i would let you all know that abbey may have a new tactic. that being they finish your overdraft and say sorry but they cannot offer another one. today after just 1 day of recieving my sorry your not happy/4 week look into it letter i recieved my overdraft being cancelled as of the 1st july 2007 letter.
    as i have £1800 overdraft and im claiming £2800 this will not be a problem as i have already organised a chat with another bank today with a positive view of transferring. SO ABBEY CAN LICK MY B***S!:p
