You're not alone, it must be the day for Abbey Defences - just received mine in the post too but not from the court from Abbey themselves???? and really don't know where i go next - need help aswell!!!
My son received his defence last week from Abbey not the court. Yesterday he received notice from the Northampton court stating that the claim was being transferred to our local court and the AQ was not to be completed unless the District Court Judge requested one and for my son to contact the court to enquire if it was to be provided. I rang the local court today on his behalf and spoke to a really helpful lady who said that they were inundated with the bank claims and a hearing date would not be sent out for a few weeks.
Although the AQ does not have to be provided the charge of £100 is still to be paid.
She also gave us the opportunity to arrange the hearing around holiday dates.
Hope this is of any help to those really anxious like us but detemined to get what is rightfully ours.0 -
I submitted my small claims papers to Edinburgh Sheriff Court today.
I phoned Abbey first and said I was in the process of printing off the papers, and asked if they wanted to make an offer over the phone before I handed the papers in. They said no, they'd just make a note on my file that I was going to court. So I went off and handed the papers in to the Sheriff Court.
The Clerk said that they would issue the Summons to Abbey next week and send me a copy, and there would be a hearing date and a response date. Abbey have to submit their response by the response date, which is a week before the hearing date. He says that claims being presented now are going to hearing dates in mid-August. :shocked:0 -

I have sent abbey my first letter with spread sheet of charges
Charges £2674
Interest £705.87
TOTAL £3379.87
Recieved letter from them 24th April
Basically saying they are sorry i have been un happy ( yeah right)
The last paragraph how ever " Although i do not know what the outcome will be, I do hope that we will be able to find a solution that you are happy with"
they estimated four weeks for a result
What do you think is this a standard keep me waiting letter or is this something different ?????
Any comments would be very much appreciated

I have just read your message
I am currently claiming back charges from Abbey too
The letter they sent me said excactly the same thing and i did recieve a reply from them within four weeks which the second letter said that they were still investigating it and that it will take another four weeks to investigate
I have just recently recived a letter from them this week which they have completed there investigation and as a ''gesture of good will'' they are going to refund me £565 including the charges that are due to come out of my account
I am clearly unhappy about this as my charges come to £3500 and i am going to take it further

I have been going through this whole process now since about January/February, it's seems like a lifetime! I put my AQ and recieved an order from the court about 2 weeks ago asking that I supply a schedule of charges to the court and the bank, I have done this, although I had sent this to the Abbey twice already! The court has now sent me a hearing date of 21st May, as you can imagine I am now panicing! Should I now put together the full court bundle (just print off what has been given as an example on this site) This means alot of paperwork in the next week?0

Just to add to all of you who are having trouble with losing their overdraft, I had the same problem, I was given ample notice but never set up another account, so when it came to the crunch they took all of my wages to pay off the overdraft (which happens every week anyway) So I was told to contact the debt recovery service (sorry do not have any numbers, not much use to anyone really am I) When i spoke to them, I asked if they could help me by giving me my wages back because I have kids to look after and feed and to set up another account for me to pay off the overdraft weekly, in the end they got so confused they re-instated my overdraft back where I started! So my advice would be to ring them and ask for help to pay off what you owe!0

Looks like there is alot of us at the moment going to court with Abbey or Shabby as we call it. I had letter about 2 weeks ago now stating that its been transferred to Manchester courts i havent had a date or anything i have been doing this since Jan now and it seems like taking forever.Whats the usual timescale for court dates .

Have done all that procedure and must admit Abbey have been very prompt in replying to me. Had a letter back today saying they'd investigated my claim and that the charges were applied correctly and as I had insufficent funds at the time, they are then unable to agree to refund any further ( I have never had any refunds of them).
Have also been sent bump on there charges and "another" how to complain leaflet and told I can take my claim to the FSO and if they don't hear from me within 8 weeks they will close my file.
This seems to be a standard letter signed by a Eamonn McFaddon, Senior Customer Resolutions Manager, there are things in it that I have not asked for ie. asking for any default notices against me to be removed. Also was told to ensure there is sufficient money in my account to cover DD and other payments. I have not used this account for 2 years so it shows how much investigating they have done.
The problem I now have is wether I should go to the FSO or claim in the courts, I would appreciate a reply from someone on this, as have posted before and there has been nothing forthcoming.
I also have the address of the Abbey legal department, where claims to the court are sent if anyone's interested.
Will let you know how I get on.

i would personally start the court line because abbey seem to be doing nothing for you!! Except keep you holding on. I started the court procedure in march, abbey haven't contacted me at all only to say their sorry about me being unhappy!! They seem to be offering people goodwill gestures, but i've had nothing!! We now have a court date of august 14th but the man from the court said they will probsbly settle before that comes!!
