    Don't worry about court dates Abbey will contact you.We decided not to contact them as we did not want to appear desperate to settle before court.We only had a date for directions but 3 weeks before court date a guy called ronan coyle from head office rang wanting to settle.This was the most enjoyable part of the whole process as you are in the driving seat.He offered us a stupid amount but we finally settled about £100 less that required amount.5days later cheque arrived.I requested our statements on Dec 4th and we received the cheque middle of april,I too thought i might be the test case but rest assured you will get your money just follow the steps and they will pay up good luck joanne

    Hi everyone
    I've been reading this thread to help me get to the next stage with my claim. I have had 2 letters so far from Abbey saying they are looking into my case and there may be another 40 days delay. Without my statements I don't know how much I'm claiming. Do I need to know how much to claim before I can send the second letter or should I re-send the first letter highlighting the fact that they should heve sent my statements within 40 days, by law? I really don't want to wait another 40 days, what should I do now?
    I hope someone can help me.

    I have only got as far as sending the second letter asking for my money back and now abbey are messing with customer overdrafts, I wonder if they will start threatening customers with their loans or even mortgages next. I am one of the customers who had to borrow money off the abbey on two occasions so that I could pay debts off that the bank charges coursed. Worried about going to court, no way bring it on.
    And the best thing to happen this week, Hugo finally got his statements

    Nearly two months after sending my request for statements on a former Abbey credit card account (sent by recorded delivery on 15th March), I've had no reply. Am about to chase via ICO. Any advice very welcome! Has anyone found a bettter way to kick them up the backside or does this seem to work?

    Some Advice At Your Early Stage...
    Be Prepared For A Wait The Abbey "shabby" Drag Their Heels Big Time !! And If They Give You A Payment Of "good Will" Dont Spend Save It Untill It Is All Resolved...

    Just first letter! I'm at the court stage with another bank, whom I started reclaiming from after Abbey. I agree it must be delay tactics; the account has been out of use for a couple of years so the longer they delay it and make out they haven't received my letters, the less charges I might be able t claim for! I sent the letter to their head office in Milton Keynes. Thanks I will also email them now. Have same problem with Halifax and been told to wait as they are deluged, but I'm not waiting any longer with these two.

    Does Anyone Know If Anybody Has Lost A Bank Charge Claim ???? And What Happens If You Do Loose ??
    The " Shabby " Has Just Sent Me A Copy Of Their Defence At It Looks So "legal" And Complicated, I Felt Nervous About The Whole Thing Before And Now I Feel Petrified !!

    Please Someone Tell Me I Am Doing The Right Thing In Taking Them On.....

    Just make sure you stick to your timescale and not shabbeys!!!
