I wrote to Abbey a while back to recover £530 of bank charges.
They wrote back saying they will not refund my charges as I was warned they would charge if I went overdrawn.
What should I do?
I'm in the process of claiming through MoneyClaim.gov.uk but want some advise before I submit the claim.0 -

Referring you back to the T&C's is a standard tactic.
However, as the charges are unlawful, any T&C's about them are also unlawful and unenforceable. As Martin puts it in the article, "if someone tells you they’re going to punch you before doing it, it doesn’t make it lawful."

When I went through the microfiche copies last week I just added together all the charges (CHG) onto the online calculator. No, you cant claim for the DDB, only a unpaid/returned direct debit that would also be listed under CHG.

Hi all, today is the day I send the court letters to the Abbey, they replied to my second letter which was the 8 weeks delaying letter but have not replied to the last letter I sent saying I was only giving them 14 days, should I call them first or just send the go ahead with the court proceedure. God luck all:rolleyes:0

Yes I had already applied to the courts online £ 120.00, then I got another letter from the Courts requesting an Allocation Fee £ 100.00, and a court date for the 22nd June, I didn't expect to hear from the Abbey until nearer the date, if at all, but then out of the blue they phoned and then settled.... Take it all the way and be confident, it really will not get to court.....;)0 -

Thank you for clearing that up for me!!
Well I added up all the CHG's on the microfiche copies and from the other statements and my total is £303.50. Letter was posted this morning!! Certainly not as much as i though they owed!! lol I Didnt include interest as it got to cnfusing considering they didnt even provide me with the full dates the charges were taken.
