    I agree, they seem to be making more work for themselves but sending it in dribs and drabs, maybe they realise it will bug us by doing it that way.

    I am bugging them like made, when i send them a letter, I email, fax and sent it in the post, that way they cant say they havent received it.:j

    Hi there,

    I have noticed that some of you have telephoned the Abbey and asked if they want to settle out of court. What number do you telephone and who do you speak to?

    Abbey have filed a defence and I am awaiting for my local court to get in touch with me with a court date. It went to my local court about 4 weeks ago, I telephoned them to find out what was happening and I was advised that it is at the District Judge's office and they will get back to me within 4-6 weeks. I didn't know if it was worth my while contacting Abbey one last time to see if they will settle now. Any ideas? :confused:

    I Was Just Wondering What Happens Now,
    Claiming £ 3111.13 From The Abbey Through Mcol They Have Acknowledged My Claim Dated 25 Th April ( This Has Been Going On Since February !! ) I Am Feelin Really Nervous About The Whole Thing. I Feel Very Intimidated By Them And All This Very Official Paper Work !! They Intend To Defend My Claim...what Happens Now ?

    My son is claiming from Abbey approx £2500 and he has now reached the stage that they were to defend by 11th May. However he has not heard direct from Abbey until yesterday when he received a copy of their defence.

    Would love to see if others have had the same defence letter he received. It has 10 points.

    I have received a copy of the defence that the Abbey have filed in court, it has 10 points so it sounds like the same one.
    I guess the next step will be getting the Allocation Questionnaire from the court, and then preparing the court bundle which Im not looking forward to, although with all the help on this site and the CAG site it will be a lot easier. Good luck with your claim.

    Uggghh! :mad: I am so angry with Abbey! :mad:

    I am at the stage where I have filed with MCOL, They have acknowledged and they have til the 14th May to put in a defence.

    I thought today that I would try and call them to see if they wanted to do some negotiating.

    I called the complaints department today in the hope that maybe we could do a bit of negotiating. I sat in a queue on hold for 41 mins. A man picked up and we went through some security- I asked if we could negotiate and was told that the bank will not negotiate as they are seeking a resolution. I asked how they could seek a resolution with out negotiation- so he repeated himself again. He then said that this was over his head and would put me through to the legal department.

    The phone rung a couple of times and then It said "The person at extension 64306 can not pick up the phone- pls leave a message"

    I called customer services and asked to speak to the legal department - was put on hold and then transferred to the original complaints number where I had originally held for 41 mins!!!!!

    Hmmmm- anyone know any good direct dials to someone to see if we can negotiate........

    Claiming 2868.02 inc interest and court fees.

    Started claim with MCOL on 18th April.

    Due to start judgement on 1st May but lo and behold Abbey put £798 directly into my account on that date.

    Received letter 2nd May stating they were happy that the charges did not contravene the Unfair Terms of Consumer Contracts Regulations 1999 and also comply with the Office of Fair Trading and that the payment was a gesture of goodwill.

    As a result I am about to send them Letter 4 from the Rejecting Offers page stating that I am not willing to accept the gesture and allowing them 10 days to pay the full amount or will commence judgement against them.

    Can anyone confirm this is the correct course of action or should I just start the judgement now as they have failed to respond to the court.

    Hi everyone after a bit of advice of course!

    I am about to start the ball rolling with Abbey to claim charges. I have a question. I have a personal and also a business account with them, should i send them off at the same time or spread them apart a little, or do it as just one big claim?

    I'm also a bit concerned about the possibility of them closing my account as I'm currently on a debt management programme and not sure how I will stand re opening a new bank account. Company wise won't be a problem as I have a good credit score there, but just personal account.

    Hi all

    This is my first post here although I have been using the site since March.

    Here is my timline so far:

    6th March - Sent my letter to Abbey asking for my statements.

    3rd April - Recieved standard letter from Abbey on saying statements in post.

    Recieved 14 months statements a week later.

    15th April - 40 days expired

    17th April - Recieved another letter with a table of charges totalling £1358 from Jan 04 to Dec 06.

    17th April - Sent letter stating they had 7 days to provide requested info or I would inform ICO.

    26th April - Rang Abbey 08459 724724 to inform them that as I had recieved no reply to my letter I was going to the ICO but wanted to ensure the requested info was not in post before I did. The lady I spoke to tried to tell me that they had fourty days the day I complained and not from when I wrote my letter.

    I will be ringing the number from earlier in this thread tomorrow to see if I can get more sense from Debbie Waghorn or Peter before I lodge my complaint with ICO.

    One question I would like to ask is this:

    If I dont get the info I want can I make an estimated claim based on the figures I already have? How long after the complaint to the ICO do I wait before I take further action, and what action can I take?

    As I have already given them a 7 day warning letter that I will be reporting them, I am going to be putting this into an email to them.

    ........I appreciate that your department is busy due to the influx of recent claims, however you still have a duty under the DPA 1998 to comply within the prescribed 40 days and you have not done this.

    As per the Data Protection Act 1998 (Part II Rights of Data Subjects and Others), Section 7(8) states "a data controller shall comply with a request under this section promptly and in any event before the end of the prescribed period beginning with the relevant day"

    Section 7(9) states "If a court is satisfied on the application of any person who has made a request under the foregoing provisions of this section that the data controller in question has failed to comply with the request in contravention of those provisions, the court may order him to comply with the request"

    Section 7(10) states

    "prescribed" means prescribed by the Secretary of State by regulations;

    "the prescribed maximum" means such amount as may be prescribed;

    "the prescribed period" means forty days or such other period as may be prescribed;

    "the relevant day", in relation to a request under this section, means the day on which the data controller receives the request

    Therefore, I am emailing you out of courtesy to inform you that a complaint form and bundle is being sent in tonight's post to both the Information Commissioner and the Financial Ombudsman Service. (a copy can be faxed/emailed to you of the complaint forms if requested).

    I look forward to a response from you today either by phone or email.

    Just got a letter through of abbey saying there sorry i am unhappy and they are investigating the matter and will either phone me or if not they will write to me in 4 weeks my letter asking for my money back is that 14 days or 7 thanks

    Abbey's time to return my charges are up today, I am now ready to claim through the courts.
    1. Do I re-work the interest out for when claiming or stick to the interest I requested when I orignally asked for the charges to be returned.

    2. Which address to you use for Abbey on the N1 form

    3. Is there a template of a completed N1 form that I can copy and use with my own details

    I've no idea even after reading hundreds of pages
