    can anyone tell me what the court bundle is, i can't seem to find what exactly i have to have!!
    any advice???

    Miss bonkers - if you go onto the CAG website, they have a zip file which lists everything you need to include within your court bundle. Go into templates Library then basic court bundle.

    I believe you have to include

    1) correspondence that you have sent and received from abbey
    2) list of charges
    3) statements
    4) case historys
    5) statement of evidence

    heya today is the final day for Abbey concerning the letter i sent saying they had 14 days or its court time.(nearly 5000K in charges)
    Having read through some of the other peoples posts i noticed that they have been offered a gesture of goodwill and had some money deposited in their accounts.(I know that you still continue with the courts etc).
    I have had no letter,no phonecalls,no gesture of goodwill................nothing.

    So now its time to go to MCOL yes??

    Hi this may sound like a silly question but i was just wondering is it as far back as 2001 we can claim or 2002?

    Abbey wrote to saying arrangements have been made to send me a list of archived transactions between 2001 and 2005 under seperate cover but i had it in my head it was from 2002!!

    Yes you can go back as far as 2001,its the last 6 years

    Thanks DeeDee07, its just i have often read people saying they havent recieved their statements from 2002 or have requested statements from 2002 etc anyways thanks for clearing that up!!

    Hi to all who have received a defence letter from Abbey. Mine gives 10 points as to why they are defending my son's claim and no further information is requested but point 10 states ' No admissions are made as to the amounts claimed by the claimant and the Claimant is put to strict proof of the same' I am assuming that this will be when we get to court or does anyone know different? He is claiming £2264 and determined to take it all the way(my son not the solicitor acting for Abbey; although he may do!!!)

    Hi Everyone.

    Today I received a letter from Abbeys Banking specialist team at Milton Keynes. My claim is for £3500, they say they have sent a cheque to their debt management department for £633 so I can repay some of my outstanding balance. My account is closed and in the hands of Abbeys debt management agency SQN. This is different from Abbeys debt management department though.

    I rang SQN twice today and one of their reps told me that this money will be paid to them. If I choose to accept it, that will be the end of the matter, and if I want to get back the remainder of my money I will have to start a new claim from the very beginning! I started this claim at the start of Dec as it is. The Reps attitude was aggressive with me and she told me this is a new ruling from the Office of Fair Trading. If I write saying I accept this offer “without prejudice” and will pursue for the remainder it will not make any difference.

    Is she mis-informing me?

    The second time I rang, a different rep told me that Abbey will be sending the £633 to me through the post, and that it is my money. I was then advised to ring Abbey and I have been all afternoon and the line was engaged full time and then you get cut off after about one minute. This is storming high quality customer service!

    I need some funds to pay the court fees so that I can take Abbey to court.

    Can any of you out there kindly advise? The point is, for Abbey to pay £633 there must be an advantage to them or some kind of trick. And does anyone know where this £633 will end up? I hope all of you get your money back, keep at it. Abbey is really doing my head in now.

    Hi all

    This is my first post here although I have been using the site since March.

    Here is my timline so far:

    6th March - Sent my letter to Abbey asking for my statements.

    3rd April - Recieved standard letter from Abbey on saying statements in post.

    Recieved 14 months statements a week later.

    15th April - 40 days expired

    17th April - Recieved another letter with a table of charges totalling £1358 from Jan 04 to Dec 06.

    17th April - Sent letter stating they had 7 days to provide requested info or I would inform ICO.

    26th April - Rang Abbey 08459 724724 to inform them that as I had recieved no reply to my letter I was going to the ICO but wanted to ensure the requested info was not in post before I did. The lady I spoke to tried to tell me that they had fourty days the day I complained and not from when I wrote my letter.

    I will be ringing the number from earlier in this thread tomorrow to see if I can get more sense from Debbie Waghorn or Peter before I lodge my complaint with ICO.

    One question I would like to ask is this:

    If I dont get the info I want can I make an estimated claim based on the figures I already have? How long after the complaint to the ICO do I wait before I take further action, and what action can I take?

    Just to update i phoned Abbey three weeks ago now to ask if they wanted to settle out of court (had already filed claim and they entered defence).

    They offered me £340, the amount actually owed was £450. I agreed to take it as i figured i'd have to wait ages for court date, needed to fork out £100 for next stage at court and if OFT make ruling it may be around what i'd get anyway.

    Solicitor i spoke to said she's email me offer which she did, i accepted and was told i'd have cheque almost immediately. Oh no, waited about 8 days phoned again, same woman said give it a few more days. So i did, called again, she made some enquiries and got back to me with, a cheque has been paid into your Abbey acc. It can't have , i said, as i closed the acc 2 yrs ago had confirmation and everything! She said must be open as otherwise they couldn't pay chq in! Great pls just send me another chq as my nearest Abbey is miles away. No can do, go to the branch with your id and withdraw funds.
    Fantastic, dragged 3 kids down into town to get my money.
    there is no way tho that acc was still open i know for sure it was closed. As soon as i'd had confirmation i couldn't access my ebanking or anything, never had another statement. hmmm, another snidey little move by Abbey i wonder. Just trying to make it difficult for me to get me money!
    To top it all off girl in branch said i could only have the daily limit of £300.:eek: this is no normal withdrawl i said, this is money Abbey owe me, i want it all.
    anyway got my £££ and could not wipe the SMILE off my face.

    What am i spending the money on..........car insurance due at the end of the month :sad: :sad:
