I have offered Abbey a settlement of just over £5000 - and they have written to me today saying they are sorry to hear I have a complaint and are looking into it but it could take 4 weeks!! Has anyone had any success with the Abbey, and did this happen to you?0

Just rang complaints to tell them their 14 dyas were up.They gave me the 40 day blah blah blah(again) so i told them no i have had legal advice and i will start with mcol tmorw and to put it on my file so they know.
I also told them NO ONE is going to keep waiting 40 days so they can drag their heels.
So let the court proceedings commence!
I would also like to point out that Abbey have offered no gesture of goodwill so dont expect it.0 -

I have been having the same prob with the Abbey. Give them 4 weeks but no longer They take ages to reply and they sent me another letter after the first saying it will take a futher 4 weeks to carry out a proper investigation. In the end i sent them a letter stating that i was not satisfied with their response. Its just their way of holding back and hoping u will get fed up. Keep the pressure on. I am just waiting for my court date now. Always waiting. urrg!!!!!!
So you are taking Abbey to court? I've got a very bad feeling here - I had a £3000 overdraft which they cancelled so I had to move banks and enter a payment plan to pay it off. My total charges for 6 years with interest was over £10,000 so I thought my letter was reasonable - am I just kidding myself here??????? Its their fault my overdraft got so high as they kept increasing it to cover the charges, even when we went to the branch and pleaded for help one month with £800 charges, all they offered us was a loan or remortgage - AAAARRRGHHHHH MORE DEBT PLEASE HELP I SCREAMED AT THE POOR WOMEN - Only to be asked to leave the bank - whoops!!0 -
Do you have to organise the court bundle only if Abbey enter a defence.
I'm going to fill the claim on line as the 14 days are up on wednesday. Do u have to attach any documents with the claim i.e statements,correspondence or is this all later after the allocation q'aire

One question I would like to ask is this:
If I dont get the info I want can I make an estimated claim based on the figures I already have? How long after the complaint to the ICO do I wait before I take further action, and what action can I take?

Skydive, try emailing the following. debbie.waghorn@abbey.com or jackie.scott@abbey.com - I sent an email to jackie today (and she read it), telling them that I will be reporting them to the Financial Omnibudsman and the ICO if they didnt send me my statements from 2001-2003 as top priority within the next 2 days. They tried that trick on me re the 40 days, and backed down when i told Jackie the 40 days starts from when i sent the Subject Access Request.0 -
can anyone tell me is there a reason why the abbey can only give you a list of charges from 2004 upwards,surely it would be just as easy to send the six years.0

I have had success with Abbey but there don't seem to be many they seem to go as close to a court date as possible. I filed MCOL and they didn't acknowledgeso I applied for and was granted judgement against them. They denied ever having had any of the court paperwork !!! After over a week of phone calls and threats of bailiffs they have agreed to pay in full, Now it just has to arrive!! They are paying £7439.07 including interest and court fee. So keep going you will get there in the end. Good Luck0 -
i'm just waiting for abbey to send their defence, they have until may 8. They havent offered any goodwill gesture, do you think i should phone them up?
the only contact i've had with them is them saying "sorry you're unhappy but blah blah blah"
any advice????

My son is claiming from Abbey approx £2500 and he has now reached the stage that they were to defend by 11th May. However he has not heard direct from Abbey until yesterday when he received a copy of their defence.
Don't panic and see this through. I am as determined as he is to get his money back. His charges were incurred when he was unemployed for 10 months in 2005 and they did nothing to help him, refused an overdraft etc just so they could make their money out of him. So angry with the banks. Don't mind them charging but not the extortionate amounts seen here. :mad:
Would love to see if others have had the same defence letter he received. It has 10 points.0 -

the statements are your original statements that abbey have sent, and the statement of evidence template can be found on the CAG website which can be used for direction c.
and on direction D. you can list all cases from the CAG website that have bee settled prior to court, to show the Abbey that you know that they have never set a foot in court.0
