Uggghh! :mad: I am so angry with Abbey! :mad:
I am at the stage where I have filed with MCOL, They have acknowledged and they have til the 14th May to put in a defence.
I thought today that I would try and call them to see if they wanted to do some negotiating.
I called the complaints department today in the hope that maybe we could do a bit of negotiating. I sat in a queue on hold for 41 mins. A man picked up and we went through some security- I asked if we could negotiate and was told that the bank will not negotiate as they are seeking a resolution. I asked how they could seek a resolution with out negotiation- so he repeated himself again. He then said that this was over his head and would put me through to the legal department.
The phone rung a couple of times and then It said "The person at extension 64306 can not pick up the phone- pls leave a message"
I called customer services and asked to speak to the legal department - was put on hold and then transferred to the original complaints number where I had originally held for 41 mins!!!!!
Hmmmm- anyone know any good direct dials to someone to see if we can negotiate........

Would / does anyone recommend emailing the bank to find out where statements are so that its in writing? Is it any use? Do they discuss info via email?

Hugo, this is what I sent via email to jackie Scott, and this is the reply I received straight away. Hope it helps.
As stated in my email to you on 1st May 2007 regarding outstanding information that you have failed to send to me under the Data Protection Act 1998, (your 40 day deadline under the Act expired on 22nd April 2007 I have also given you extra time in which to comply), and despite various letters and a phone call on 19th April 2007 in which I personally spoke to you, you have failed to contact me or send me the information I requested.
I appreciate that your department is probably busy due to the influx of recent claims, however you still have a duty under the DPA 1998 to comply within the prescribed 40 days and you have not done this.
As per the Data Protection Act 1998 (Part II Rights of Data Subjects and Others), Section 7(8) states "a data controller shall comply with a request under this section promptly and in any event before the end of the prescribed period beginning with the relevant day"
The letter requesting the information under the DPA was delivered to your office on 13th March 2007 by recorded delivery, and therefore this is the "relevant day", meaning your "40 day prescribed period" was up on 22nd April 2007.
Therefore, I am emailing you out of courtesy to inform you that a complaint form and bundle is being sent in tonight's post to both the Information Commissioner and the Financial Ombudsman Service. (a copy of both complaint forms can be emailed or faxed to you, should you so wish).
I look forward to a response from you today either by phone or email if you wish to discuss this, before the form/bundle are delivered via recorded delivery to the parties mentioned above.
She wrote back with
Dear xxxxxx
Our Bradford offices are dealing with your request and I have forwarded your emails to them. The information will be with as soon as possible.
I then emailed back to her with ..........
Thank you for responding so quickly to my email. However, do you have an expected date of when I can expect to receive the information, as obviously I don't want to hold off sending the information to the ICO and FOS, and then find that I am still waiting for my remaining statements in 1-2 weeks time.
If you are unable to give me a date of when I can expect the information, can you ask your Bradford Office to call/email me today with an expected date. Otherwise, I will have no alternative but to send the complaint forms off, as I have heard reports of people being told they will have to wait between 4-6 weeks after the 40 day deadline to receive their transactions/charges for the period from 2001-2003, and I am not prepared to wait this long.
Miss Scott then wrote back with Dear xxxxx The information was sent yesterday, so it is now in the post.
So I finished it off with Thank You,
I will obviously contact you again if I havent received it by Tuesday 8th May 2007.

Hi, just got a letter from the court saying they have set a date for the hearing to be 18th May. However at the bottom it says
"AND IT IS FURTHER ORDERED THAT the parties to inform the court of position at end of month"
Letter is dated 20th April but only arrived yesterday. Should I have been in touch with the court by the end of April? What should I be informing them of? Not sure I understand what is required at this stage.
Anyone had anything similar?

Postscript, just called the court and they are not sure what it means either, so I have written to confirm that I wish to pursue the claim.

I could be wrong but maybe the courts are so tired of blocking out court dates knowing full well that the banks will settle, that they are requesting in advance that you/bank let them know what is happening i.e whether they are agreeing to settle etc/you are in neogiations with the bank before the court wastes its time in sending out AQ and directions.
I would ring up the court and ask them to clarify though what it is they want from you.

A word of advice for all those requesting their statements or sending their 1st up to their fourth letter. Due to mine own personal experience and I've been looking at this thread since it began. Your best bet is to take Abbey to court right away or at least after you get your statements because the chances of you getting a full refund are almost impossible without settling it via the courts.0

I will certainly try emailing them!! I only sent my letter on the 30th and they didnt recieve in until the 2nd so i will wait a day to email! I havent even filled in the financial-ombudsman form yet incase i have to complain!! Will do now so that i can email quickly!!

:wave: :wave: Hellooo!! Just had to write and tell everyone that this site and all the posts have spurred me on to claim over 9 grand (gulp) from the Abbey. Have just sent 1st request letter for repayment and fully expect Abbey to take it to the last possible minute. Letter went today so wish me luck!!:T

Yeah good luck I sent my 1st Letter to Abbey 19th Feb had two letters back saying the usual they are still investigating, tried to ring complaints I am put on hold and have never as yet got to speak to someone. I am also reclaiming over £9 grand, to make matters worse last month they charged me £30.00 for going over my O/d by 3 Pence. I am really angry now, and will not give up, I am going all the way with this.0 -
I sent my first letter 22nd Feb, and am now ready to enter a case through the local courts, I have filled the N1 form online and printed it off and attached a copy of charges and interest calculations , I have made 3 copies for Abbey/Court and myself.
Is this enough? , I'm ready to take the paperwork to the local county court in Bradford.0
