    a word of advice to anyone contemplating to write,e-mail or phoning so as to settle..........forget it Shabbey will not bother........the only time they will negotiate and come runnin is when they receive a court date then the ball is in your court......i offered to settle to save them further monies.....an Inga wanted a more "commercially palatble offer"..................screw em!...........goin for every penny £6k+

    Shabbey only deals in delayin for every 1 person on this site there's another 50 joe public who knows nothin of GAG or martins site despite the publicty so they will not push the issue as far as court and will settle for GOGW amount and lets face it the court stage aint a walk in the park still alot of research needs to be done.........and the win alot more satisfying;)

    I am claiming £1300 in total, with interest

    I have received notification that they will defend the court action. Through all of this I have not once received a personal letter, only the usual, "we are sorry it is taking so long". In contrast, Firsdirect were brilliant in settling upfront £1600!!

    I sent the template letters and although I received replies, they never specifically mentioned anything, other than "my complaint". This in my view is their way of denying that there is a problem with their charges. I waited out the 14 days and have now proceeded with the online MoneyClaim action.

    They really are trying to scare me! But even though I am a little scared, I will stand by what I think is just and fair.

    Abbey claim £1446.10
    Abbey paid £1795.55 including court fees/interest/allocation questionnaire fee.

    This is really simple.

    1. Ask bank for 6 years statements.
    (i went to branch with letter & cheque)
    if 40 days pass, estimate charges & tell the bank police. Continue with claim.

    2. Use site calculator to make spreadsheet for total charges & interest.
    (spend an evening to do this 3 times, just to make sure.)

    3. Take/send 1st request for refund of charges letter(14 day) to bank with charges spread sheet.
    (I took to my local branch & made the manager photocopy & sign for my records.)
    Ignore blah blah letter informing you of 4/8 weeks

    4. 14 days later, take next letter giving 7 days notice of court action.
    Again my bank manager photocopied & signed for me.
    ignore the charges they have paid back into your account. Contact your manager & tell him to remove the funds. He will tell you it will not affect your claim & will leave it there.

    5. 7 days later fill out MCOL & pay fee. Use bank head office address. Fee is usually covered by the bank refunding recent charges to please you.
    Ignore letter asking you to send them copies of your claim, you have handed in/posted already.
    Ignore offer of early settlement & fill out the Allocation Questionnaire and return it to court.

    6. Court date will arrive with a date the court bundle has to be presented at court. Wait... wait... wait...
    Letter from bank will arrive offering full amount including interest allocation questionnaire fee & court fee.

    7. If no letter arrives, put court bundle into court & wait for letter of full settlement.

    8. Wait for funds to clear before telling court to stop.

    9. Don't ring, email or contact other than the initial 3 letters to your branch.
    Banks are not prepared for the court action. It takes them a minimum 4 weeks to deal with a complaint.


    They only have 3 weeks before court papers are served.

    My claim took 3 months altogether. The court wait will get longer with influx of claims.

    Incedently, the refunded charges that covered my court fee, were not deducted from the final settlement.

    They do not have the time to go through the charges, hence they ask you to send charge details again.

    I was paid £100 for filling out the allocation questionnaire without asking.

    If you give them any chance to delay, they will.
    The courts delay enough, which is good as your interest continues to grow.

    I will not wish any one good luck, as luck doesn't come into it.
    It is all fact based.

    So stop panicking, relax & forget about it.
    (this was easy for me as i have a private law case running concurrently for access issues concerning my 6 year old son, depression is terrible)

    i've done everything the same as you Devil482, the only contact i 've had with abbey were the 3 letters. All i've heard from them was the "We're sorry" letters. It has now reached the point where abbey now have until may 8 to send in their defence,i'm not scared of taking them to court , as they have my money and i want it back .. its the court bundle that has me a little scared. Ive got three of all my letters to them, my statements, letters from them, but what else is there to put in??

    Any advice??

    just received by list of transactions from 2002 today. totally different to the nice table of charges received 2 weeks ago. Hugo the best thing to do is phone them everday and send email just like the one missjules sent

    Thanks Kev, glad you finally recieved them!!! is it hard to work out the charges with this different transaction list?

    big hi to all
    i think i am now ready to send by second letter to the bank giving them 14 days to give me back the money that they have charged me for the past 6 years.Can you just teel me if this is correct.
    1. i send the letter to my local Abbey branch.
    2. A copy of the template letter requesting my money back.
    3 A copy of the calculator print out.
    is this ok or do i need to send them more.
