They have defended my claim and now I have received a letter stating that my case is now being referred to the County Court.
I have received a full letter from the court stating what their defense (all sorts about how they have the right to charge me etc) is and telling me I will be given a court date
Has anyone else had this and should I be getting worried ???

This is where i am at at the moment i recieved my letter this week stating the same. My amount is for £4131, i was getting a bit worried but when i came on here i was told its just a delay tactic so stick with it.

I am in receipt of the documents that you have supplied in response to my Data Protection Act Information Request dated xxxxx (and received by your office xxxxxx via recorded delivery). The disclosure of personal data is incomplete in that at least the following documents are missing.
1) You have failed to provide a complete list of transactions and charges for the period from March 2001 through to December 2003.
2) You have failed to provide details of the exact dates the charges were taken from my account for the period from Jan 2004 through to December 2004
This is not an exhaustive list by any means, it is just an example of some of the information I am missing.
Accordingly, I have to tell you that you have not yet complied with your obligations under the Data Protection Act 1998.
The time for compliance with my request has now expired. If you do not comply fully with my Subject Access Request within 7 days, I shall apply to the County Court for an order to enforce compliance, together with damages at the discretion of the court. I will also be making an official complaint regarding this matter to the Information Commissioner and the FSA.

is it 40 working days or just 40 days. Today is 43 days for me or friday 4th is 40 working days. I did phone them today to try and move them along so hopefully I will get them before I have to complain.

Hi Michelle, i believe its just 40 normal days from you sending your letter!! Have you sent a second letter giving them 7 days otherwise you will report them to the Information Commissioner for breaching your DPA Rights? If not do so to hopefully hurry them up for you!!!

i have just opened a letter from abbey i sent a letter to them 4 weeks ago with details of the amount i felt they owed me including interest around £490 all logged down for them so they know dates etc, but the letter today says
"As you know we are currently investigating your complaint that you raised with Abbey Four weeks ago. I am sorry for the delay you are experiencing and i would like to take this opptunity to thank you for your continued patience.
Our research is taking longer than expected because we want to make sure a full investagation is done. If we are unable to complete our investigation beforehand we will write to you again in four weeks time to let you know how we are getting on
I am sorry that it is taking longer than originally thought and would like to reassure you that your complaint is very important to us."
should i write again ? i took around two hours to go through the statements they sent me work out the interest write the letter and put it in an envelope,so why is it taking them sdo long? they have all the details there no doubt on their computer and what i have given to them or should i wait?
Feel like writing but don't want to blow my chances!!

I have just issued my claim against Abbey with MCOL.
Abbey are cheeky. I wrote to them 5 weeks ago stating to pay back my charges. They responded stating they will get back to me within 28 days. After 21 days I wrote to them again stating they have 14 more days otherwise i will take them to court. Today 35 days after the original letter they have stated they will get back to me within 28 days. If it were the other way around the bank would not accept that, I am no different so off to court we go!
Claiming more of Natwest £4.5k compared with £3.5k was done within 3 weeks, Abbey are very slow at processing these claims, looking through the thread it seems like they just try to play delay tactics with everybody.0 -
Hi all,
does anyone have a basic template for a letter acknowledging a bank's depositing part of a claim as "gesture of goodwill", that refuses to accept it as full settlement, but that is willing to accept it as part settlement of the claim?
Just a basic wording would do that uses the correct terminology.

see that i am not the only person having trouble getting all the statements. just read the copy of the letter missjules posted and i think that the way to go.i did contact abbey today and all they keep telling me is it will take another 4 weeks to receive the other statements. i suppose we could also make a claim for the charges on the statements we have now and then make another claim on the other statements when we receive them.0
