Hi nejen, glad to here you eventually recieved all your statements
I was just wondering did you recieve your 04 - 06 statements in a table format and if so how long after recieving them did you have to wait for your 02 - 03 statements if you dont mind me asking?

Yeah, I got 04-06 in a table just over a week ago, then got 01-03 today - lists of transactions. The charges are quite easy to spot tho.0 -

Thanks nejen, did you claim for interest on top? I am finding if hard to claim for interest on top because in the table of charges they sent me they didnt included days of charges and only month and years were included so i cant enter any results into the the interest calculator as it doesnt work without days!!0 -

abbey charges are taken from account usually on the 12 of each month.

I sent Martin's letter to Abbey asking for a partial refund of the excessive mortgage exit fees on Monday. I had my mortgage number but no other details as I changed mortgage companies in Nov 2005. I complained to Abbey at the time that the £225 was excessive but they told me to get lost. Heartened by others on here though I though I would give it a go, albeit 18 months later.
I had a letter today from Abbey asking me to complete a form and saying that if I had taken a mortgage when the stardard fee was £99 they would refund me the difference from the £225. I took the mortgage out in Oct 2003 and I know from querying the exit charge first time that there was no mention of the £225 charge so I'm hopeful of a refund:T~Laugh and the world laughs with you, weep and you weep alone.~:)

When sending a letter regarding claiming charges back are we all using the abbey complaints address at milton keynes ?

I received a letter dated 16 April offering a partial repayment of charges. I was claiming £1,160 to 17 February 2007. Since 17 February further charges of £325 have been added to my account, so I am in fact now entitled to claim £1,485. However, Abbey have written to me offering me £935, but they say "to include the cancellation of charges yet to be debited to your account". Since they sent this letter (16 April) £590 of charges have been refunded to my account. Does this mean that they are now offering me a further £345 to total the £935? The charges they have refunded don't make sense. Since they wrote the letter they have added two charges of £35, three of £30 and one of £20, a total of £180 - which I am asuming they were referring to as the "charges yet to be debited" to my account. So why have they refunded 15 charges of £30 and four of £35 (£590 in total)? I am really confused.
Has anybody else had this, or can anybody explain this to me properly?
They also said in their letter that they were enclosing a complaints leaflet explaining my rights, which they haven't, only two copies of the letter for some reason.

They've made a partial offer which is very common with every bank. You can choose to accept this and end the claim now or you can continue with the process and reclaim all of your charges, its your choice really how to proceed. You can also to choose to accept this as 'partial settlement without prejudice' (that bit is important) and advise them in writing that you will continue to reclaim the remainder at court if neccessary.
With regard to the complaints leaflet, this isnt necessary in the process you are following. They would be if you were to escalate you complaint to the Financial Ombudsman as you would be required to exhaust the banks complaints procedure first. Since you are following timescales necessary to show the court you have given the bank ample oppertunity to resolve your claim before any court action taken then you can now go ahead and send the LBA (letter before action) and carry on regardless.

Hi Emma, i believe that when you are sending the template regarding claiming charges it can be sent back to your local branch!!!
If im wrong then please somebody let Emma know!!!

Thanks Kev, im just abit worried because if i am claiming to much back that im owed (as intrest differs day by day on the calculator) and i get to the court stages how will this look or effect my case?
