    Hi again,

    Continuing from post #1117;

    Started the court process and still within the first 14 day period. I note that the day before I signed up at the MCOL website Abbey "planted" £200-odd into my account, roughly a quarter of what they have taken from me in charges. Saturday (21/04) I received a letter from Abbey regarding how they are justified etc etc, but as a gesture they will credit my account x amount etc.

    My query is, do I just ignore this given that I have started the court process, or am I required to inform Abbey in writing/by phone that I am unwilling to accept their offer?

    I've given Abbey 14 days from 18 April before I take them to court. What do I need to prepare before it get's to the stage where I use MCOL. Any links to templates or evidence reagrding the charges would be useful. Or list of things that should be prepared.

    Just got off the phone to the Abbey legal dept, and have agreed to £2,800 in settlement of my claim. (total claim £2950, but they already refunded £280 without my asking).....I think thats called a good day!!!! Had a court date set for 17th May and was set to wait until then for them to make an offer, but low and behold they emailed last week with an offer of £2400 which i rejected, then emailed this morning with an offer of £2600. Gave them my mobile they called 20 mins later and told a few white lies (going on holiday tomorrow and want to sort this out today, already got my court bundle ready etc) and then simply asked for £2800, after being on hold for 1 minute they came back and said ok. Picked myself off the floor and said ok, confirmed that there were no conditions attached to it and that was that. Just wait for the cheque now.....hope it doenst bounce!!!
    Word to the wise, their security doesnt allow them to recieve emails from Hotmail and such apparently.
    Celebration packet of wine gums for me i think, then off to start a claim for more than 6 years back, then Ive got LLoyds in my sights too!

    hi just got the rest of my staments through and add them all up going topost my letter tomorrow my total to claim is £2230.00

    Hi there well done what number did you ring and what stage did u get to with your letters i am just about to send my letter asking for my charges back please help
  • hi Kat,

    Got all the way through the letters, Money Claim online and got a court date set. So just stick with the guidelines and everything will work itself out over time (wrote my first letter in November!!!). I waited for Abbeys legal team to ring me, by that stage they knew i was serious and didnt try to fob me off with silly offers. Stick by your guns!!!!

    i have recieved a letter from northampton court saying the claim has now been passed to my local county court.i have phoned my local court enquiring about an allocation questionaire and was told this is not always needed,and to wait for them to be in touch.
    does anyone know if this is correct and also now a defence has been filed what sort of time scale am i looking at until it is heard in court?
    any help/advice appreciated


    i have still not recieved anything from the court since it was transferred from northampton to my local court,should i be chasing them up or just carry on playing the waiting game?

    kat when you say that you received the rest of your statements are they the ones before 2004,if so how long did you need to wait for them.

    Kev, i seem to be at the same stage as you - still waiting for statements for 02 - 03, Did you get days listed as well as month and years on your 04 - 06 statement so that interest can be added on top?
