Does anyone know why abbey are only sending a summary of bank charges charges for Jan 04 up until Dec 06, and not for the requested 6 years.Its taken them over the 4 weeks to send these to me and now they say it could take another 4 weeks for the other statements to arrive. I wonder if its some kind of delaying tactic.I tried to get a answer from abbey today but was sent from pillar to post so i gave up the quest. I know there are others who received the same summary of bank charges this week and i am wondering if any were lucky to find out whats happening.

According to the covering letter I received with mine this is a new system they have put in place recently to deal with the backlog of requests. Information pre-2004 is archived and needs to be represented to us to be fully comprehensible and so takes a little longer. If they delay past 40 days you do of course retain the right to complain to the ICO at the delay.0 -
Hi guys
Have now sent the letter before court action to Abbey but in the last few days they have sent me letters telling me they will be applying charges in the next 22 days for unpaid DD, SO etc. These were mainly incurred due to them taking their charges out the day after they said they would so I thought I had more money than I actually did.
Now for my Q- can I add these charges to my claim? I have already sent them a schedule of charges and interest total but it seems unfair that they can still keep applying charges we're looking at nother £300.
Any advice greatly received.
You can add charges right up until you file claim at court. I would personally try and time it to co-incide with receipt of my next monthly statement to add on any charges marked as pending on the statement. Good luck0 -
My 40 days were up yesterday, I spoke to them last week and they said they should be with me this week. if they are not here by thursday, then I will be sending them a letter informing them i will be issuing a small claims court to make them comply, and that I will also be reporting them to the FSA and ICO.
With regards to the lack of date the charges were applied to my account (from their useless spreadsheet), When I have looked at previous statements, they seem to apply any interest / charges between 6-9th of each month, (no later and no earlier than that) so when it comes to the time to send off my charge/interest schedule to them, I will put the 9th down for each time they charged me, that way if they took the money out on the 6th for example, they cannot moan as they have gained 2 days interest out of me.
Just a thought, if they are not supplying the exact date, does that mean they havent supplied a complete list as we all requested in our SAR? and does that then mean that they have not complied with the data protection act? does anyone know?
As posted above. It would depend on how the SAR was worded. They are aware though that the date is important in court claimsto calculate interest and may well have exploited any request not stipulating the requirement for dates. I would still mention in a letter that this point is subject to complaint to the ICO for the seemingly deliberate omission and that you require those details in a timely fashion.0 -

I've sent Abbey the first letter i received a response acknowledging the £10 and got about 3 duplicate statements and nothing else, i sent a letter telling them i hadn't had what i asked for and got no response so then i sent them another letter (recorded) saying that their 40 days to reply was almost up and if they didn't respond i would be contacting the information commissioner.
I got a reply straight away saying, " we are sorry you have had to complain we are looking into your complaint this will take no longer than 4 weeks etc, etc"
It said something at the end about any refunded charges will only be put into a live Abbey account, which brings me onto my next question.
Last year when i bought my house i opened a joint account with my fiance at Barclays (who she was banking with), i had a £500 OD with Abbey i got a letter saying i had stopped using the account and i needed to make regular payments to bring the overdraft down. I did for the first couple of months then i didn't, then next thing was i got a letter requesting i returned all my cards & cheque books and that i had 30 days to pay the OD off. I couldn't afford it in one month and despite offering to pay it in two months, they wouldn't except that.
They sent it for default and i agreed to pay £50 a month until it was paid (8 months) but after 3 months i paid it in full. They then took another payment so my account would be £50 in credit.
I was told i could just go into the branch and get the money, but i went in today and they said they couldn't do that as they had closed my account, which is standard practise if you default.
They said they'll send me the £50 they owe me (for the overpayment) in the form of a cheque, but i was wondering
Because my account defaulted can i still claim my charges back?
and two if they have closed my account can i stil claim my charges back?
sorry to ramble but i wanted you to have the full story. I totalled up about £400 on three statements alone but i haven't got them all for the last three years0 -

You can still reclaim your charges regardless of it being closed or defaulted. You are also entitled to the full 6 years details of the account regardless of it being closed so keep pushing for them. You can state that since they have stipulated charges will only be paid into a live account that you require payment in full by cheque payable to yourself. They cannot withold your money so, as previously when you have tried to get your own money out, they will have to send you a cheque.
Dont be put off by these hurdles and just work your way calmly and methodically through them. Consumer Law is in your favour here and it is only a matter of time. Good luck0 -

Well spotted, I hadnt noticed ! In the absence of a date it would be safe to assume the date of receipt of your monthly statement could be used for a rough guide as to the amount of interest. If the claim gets as far as court we will need the exact date of each charge and I will be writing ASAP to ask for this.

Its took me so long just to get only some of my Microfinche charges i can see asking for the days of charges getting a whole lot longer to completeI have no doubt it will lengthen the process but depending on the wording of your initial letter requesting the details then they should have sent this information as part of your SAR (Subject Access Request) and within 40 days. The template letter does not specify the date of charges so perhaps they have exploited this, who knows. I know I amended my template and asked for the charges to be laid out as Date Applied, Type Of Charge and Amount Charged so I intend to complain at the omission of the dates.
As this is a new system they have in place to deal with the volume of requests it is possible that this fact was overlooked. At the very least you can mention to Abbey in writing that this point is subject to complaint if the omitted information is not received in a timely manner.
Twinkly, the wording in my intial letter was exactly the letter from moneysavingexpert.com. If i ask Abbey for my omitted information (days) now im worried this will delay my remaining account charges for 02 - 03 which i still have not recieved - i'm worried if i ask for this on top they will get confused - any ideas how long they may take to arrive? on the letter it says as soon as possible - has anyone else recieved 02 - 03 seperate? any advice is gratefully recieved !!0 -
Just under two years ago, I became very frustrated with Abbey's complete and utter incompetance. They changed my address when i hadn't even moved, transferred money out of my wife's account when they should have transferred it into hers, sent my bank statements in unsealed envelopes on three occaisions and sent them to a different person on four occaisions. The last straw for me was when they charged me an unauthorised overdraft fee, six days after I had received a letter from them stating that the overdraft had been agreed. The only reason I had to arrange an overdraft was because they had charged me incorrectly on my credit card!
A year after we switched banks, my wife got a letter from Abbey, demanding £185 in interest (!) for a £1.36 transaction that went through, just as the accounts were being closed.
In the end we switched to Alliance and Leicester. When that happened, Abbey were supposed to cancel a standing order I had into a joint account, which they did not do. As a result, I was hit with £280 of charges.
I want to claim this back, but as I've changed banks now, can I still do this? The money isn't the issue, for me it's the principal of it and I really want to make a point to Abbey.

Hellooo fellow Abbey bashers. Just had the post today with the standard "We're sorry you are having to complain....(yeh right)" load of flannel. Not too shabby in getting that letter out, they would only have received my 1st request for refund last Thurs and this letter was dated yesterday, shame it took them 6 weeks to send the back dated statements tho. They are saying it can take up to 4 weeks to investigate (4 weeks my a**e they've got till next thurs before I go on to the next stage) and have the brass b******s to say they won't be charging me to investigate my complaint.:rotfl:
Just a quick question, apologies if been posted before, my claim is for just over 9 grand:eek: is it worth splitting it into 2 separate claims for small claims, or just to keep it together, and how much (roughly) will it cost to start MCOL (should it get to that stage, and knowing Abbey I know it prob will). I recently successfully reclaimed all my wife's old bank charges with interest from Natwest. So I decided to do the same with my Cahoot Abbey National account.
The amount I claimed back from Cahoot was around £300 (much smaller than Natwest )
I followed the steps - writing etc asking for money back, then filled out a cliam on Moneyclaim
They have defended my claim and now I have received a letter stating that my case is now being referred to the County Court.
I have received a full letter from the court stating what their defense (all sorts about how they have the right to charge me etc) is and telling me I will be given a court date
Has anyone else had this and should I be getting worried ???0
