    Does the letter say you will be sent an AQ or has this bit been scored out. Generally the AQ will be posted out with the defence but some courts are dispensing with the AQ now.

    the form says "Please read the accompanying documents carefully and note that the allocation questionaire should be returned to my local county court. The bit thats underlined has been crossed out.

    it also says that all further communication should be addressed to my local county court.

    So no, they havent sent a AQ, does this mean i dont need one?
    And do i just wait for a date to be set now? If so, i havent a clue what i need to take with me, i plan to do some reading tomorrow on the CAG site.
    Would you recommend this or is there something on here thats hiding? as i thought i had read everything i need to on here so far...

    Sorry I didn't realise you had a court date. As the mention of AQ hasn't been scored out then you do need to ask for one.
  • i accepted an offer from Abbey of £340, amount owed £450.
    Agreed over phone, offer made by email and i also replied that i'd accept this money. That was on 10th April and i have still had nothing.
    I have spoken with the legal team dealing with it and she assures me money is coming by cheque (abbey acc closed a while back).

    only thing is I hope they don't back out now as my final day for filing AQ was on 20th April. Stupidly i have not done it as was hopeful chq would arrive by then!
    have i messed up if they don't pay up? or is email offer from them enough to get my money? :confused:

    The story: Sent two letters. Couldn't affort the £80 court costs yet so waited. Letter turned up offering this. Wasn't expecting it as Abbey seem to be stubborn. Have declined it and said "see you in court to breakdown your charges by the penny" awaiting reply.

    am, just waiting for abbey to send their defence, as i have got their "acknowledgment of notice" can anyon tell me what i need to have ready if it goes to court.

    Abbey paid up. The amount claimed + interest at 8% + extra interest accrued since the date of claim + £30 court fee. :dance:

    Mine was a modest amount of £329 but thats of no matter as, at the same time, they settled amounts of £5000+ and £8000+ for two people on CAG at the same stage as myself.

    It's not being disloyal to this site to go to Consumer Action Group (CAG) but they have everything you need for court bundles etc just ready to print off.
    Also fill in the online complaint form at the Financial Ombudsman Service, regardless as to whether you have begun court action......it all helps.

    I had prepared a skeleton argument and sent it to them and to the court, and also stated that I would be asking for my costs in preparing my case due to their time-delaying tactics, an additional £500+.
    They knew exactly what information I would be using in court. Two weeks on they have settled.

    Ironically, I've just received the court date 8th June, and also a letter from FOS telling me what information they are going to request from Abbey....lol...no way would Abbey want to provide what they have asked for.

    Keep at it, get your facts straight and learnt by heart, and you will win.

    I havent had a date set yet, but the allocation questionaire bit has been crossed out, i'll ring the court today to see what they say..

    No where on the letter does it say i've had a date set.....sorry if i didnt make myself clear on my last post!

  • I know this may not be the right thread but I wrote to Abbey asking for a refund of charges totalling approx 1200 pounds and they wrote back to me offering 20 pounds. What should I do now?

    hi all
    received my abbey statements from 2004,still waiting for statements from 2002,on letter from abbey statements will be sent out to me asap, when i contacted abbey asap means 4 more weeks.
    i dont think so, complaint going in at end of week.

    Hi all,

    I was wondering if anybody could please help me.

    I received a summary of bank charges this morning showing charges of Jan 04 up until Dec 06 along with a letter stating that if my account was opened before January 2004 (which my account has) details of charges for this period will follow as soon as possible.

    The letter was basically a table outlining charges, is this normal? it included Total cleared transaction charges (totalling £280.00 although its states £40.00 was refunded in May 04) Can I claim for the remaining charges that have not been refunded?

    I was also charged £32.00 in Aug 04 for unpaid cheque charge. Can this also be claimed for? I just really confused in what I can claim as the wording Abbey use is different to on this forum.

    Also I can’t seem to apply for interest on top as Abbey have only given me the month and year and no day so when I put charges into the calculator it isn’t adding interest.

    Any information and advice would be very gratefully appreciated.
