    maybe they now realise there is no getting away from it and complying or it is a delaying tactic. Am I right in thinking its 40 WORKING days if so then thats 8 clear weeks and so they have another couple with me.

    Like some others I have a complicated situation, got a £3300 OD which is totally maxed with them and am in payment plan with CCS so could only get a very basic account with N & P which doesnt give a debit card just cash card. While I am not looking for an OD (be good to start paying the other one off) due to my circumstances I do need a debit card. So dependant of how much it is I may not actually claim in case they close my account.

    Have my mortgage with them so would hope they wouldnt but of course there is no certainty of that.

    Let me know how you all get on.

    p.s does anyone know if I could claim charges for the credit cards that are part of the PP with CCS.

    It looks like this is the way they are coping with the high demand for details and it is welcomed by me personally. The nice neat list has saved my poor eyes trawling details presented any other way. The charges totalled on each column at the bottom are easily added up then the refunds totalled at the bottom easily deducted, very quickly giving the amount for reclaim..

    The table of charges needs to be cross referenced slightly with the 14 months of statements also received but I have got to give them credit for a job pretty well done there.

    This might not be a popular view but I am prepared to allow them slightly longer than the 40 day deadline for sending my details. It is clear they are working to finding a solution to cope with extra demand and not once do I feel I have been 'fobbed off' in this process. Having watched the Whistleblower program on BBC1 a few weeks ago and seen how Barclays treated their staff so badly I genuinely feel that the staff at the bottom of the ladder having to deal with our details requests deserve a little compassion in what must be a never-ending demand. Yes I know the banks didnt hesitate to charge but I blame the banks policy for that, not the everyday staff working to support their families just like everyone else.

    Yes I agree having the list sure helps, I had already done it with the statements which wasn't so bad but of course you then need to list it in table form before claiming.

    While I agree its not the staff who we have to deal with fault (although I have had occassion to challenge some staff's attitude on the telephone in general) but their bosses. I do think in this case keeping to the timescales is best as its the higher ups that make the decision on the refunds and they deserve no mercy lol

    Hi Michelle, I am in the same boat as you with the OD, ours is £2200.00 Hopefully they wont close our account, but if they do, I think most of it will be paid off by the money they have taken. Did a rough tally today, and they owe us just over £1500 for the past three years.

    If you have your mortgate with them, I would be suprised if they closed your account as they know you would then take your mortgate elsewhere.

    I agree with you about the list, they have done a good job. I too cross referenced it with the statements they sent me, and they havent omitted anything.

    Good luck everyone, nice to know that people are at the same stage as me. I will give them till latter part of next week before I demand the remaining list from them (waiting on 2001-2003). I just want to get onto the next stage now, they have had my money for long enough.
  • I made a claim for unfair charges of £2557 to the Abbey.I have just recieved a letter saying that they are satisfied that the charges do not contravene the Unfair Terms in the Consumer ontracts Rregulations 1999 but, they will refund £785 as a good will gesture, does this affect my claim as i'm not willing to accept such a small payout, and also by them paying me are, they admitting to the charges.Please could someone help me with my next move?

    Not sure if this is of any help to you but Natwest do an account with a SOLO card - it's called the "Step" account. It's their basic bank account. Halifax also do one called "Easycash" which has a Visa Electron card.
  • I have gone through all the stages: requesting statements, asking for money back then threnting them with legal action. I am claiming back £4k worth of charges (i banked with them for about 8 years).In one day, I was charged £32 about 8 times!!!!

    I got a response saying as a gesture of goodwill, they offered me £20!!!!

    Let me see, i am claiming £4k+ and you want to give me £20! I wrote back saying this was insulting and I sent another leagl action letter. After about 3 weeks with no news, I called them and said I might be confused and maybe they accidentally missed off a couple of 0's from the letter, the guy said they are only prepared to pay me £20!!! He said it was up to me what I wanted to do and I can take them to court but its my perogative!!!

    I have now sent a letter with all correspondent to the financial obmusdman!

    Fingers crossed! I am prepared to fight Abbey till the end.

    If you go onto the CAG website, they have template letters where you reject the offer. If they have already put the money in your account, there is also a letter on there which you can send telling them that you accept the £785.00 as a goodwill guesture but you will be taking them to court for the remaining amount.

    Thanks ladyknight...but the 08457 number was actually printed on the letter I got from abbey, I just thought it could have been a deliberate stalling attempt by them.

    Anyway, recd a list of charges from them this morning but only back to 2004.
    They say because of the huge amount of people asking for their statements the rest will follow asap! Shame I've already reported them to the ICO!!

    ANYWAY ... gonna hold out for the court result, if Abbey make a defence or not, even if they do I'll still meet them in court, (hoping they won't turn up).

    CAN I now change my claim to charge £5 per letter I've sent and an amount for each time, not often granted, that I've had to ring the ShABBEY ?

    Felix you should charge the Bank £35 for each letter you sent and explain that "These charges do not contravene the Unfair Terms in the Consumer contracts regulations 1999."
