    I have been slogging away at this for some time now-
    I requested my statements at the end of October and they were not received til the end of January!!! I snet my first letter and had all the standard replies about waiting 4 weeks, so sent my sencond letter and got £420 refunded out of a claim for £2600 (incl. interest)
    Has taken a while to have the money to start the court claim but did that last week and it was deemed as served on Monday just gone - so now waiting to see if they acknowledge / defend etc etc.
    I just want to get it over and done with and will admit that I don't really want to settle for a lot less thanthe total- So if they ever do call me to negotiate I will have to reallystick to my guns!!

  • Hi I have just recieved a letter from Abbey saying that they have investigated my complaint and that the charges they applied from 2001 to 2005 were correct as i had insufficient funds in my account. I am reclaiming £540. I have filed a claim at moneyclaim but am so concerned that it will go to court and they will win through a technicality fault or something. The court letter came through to say that they have until the 5th May to reply. What should i do? Im worried to say the least.

    You should do something to help you relax is my advise :) Providing you have followed the steps laid out here then everything they try to throw back at you is going to be straightforward to deal with. Some stats for your consideration taken from the first 98 pages of the success thread:

    Abbey National - 18 cases of which:

    11 settled in full plus costs and interest after claim filed at court
    5 settled in full before any court action neccessary
    2 claimants went to the Financial Ombudsman and the banks paid in full for one and more than the amount claimed for the other but no reason for this is given in the post
    1 case the claimant claimed £5,000 he had estimated as owing. The bank settled at £4,500. On receiving his details and checking he was only actually owed £1,000. There is no mention of them getting the overpayment back

  • Hi, I am just about to fill in the online forms to take the Abbey to court for my dad. The last letter that he got after sending the letter threating court actions said that they were still investigating and if he was not happy to take it up with the financial ombudsman. Should I do this or fill in the court forms? also if I take them to court for my dad and he has to go to the hearing can I go with my dad and do all the talking?

    For all you who have not received your 6yrs statements and the 40 day deadline is nearly up. Their latest trick is when you ring them to find out where the microfiche part is and you tell them the 40 day deadline is blah blah, they try and fob you off by telling you that the 40 days starts from when the Bradford Office of Abbey requested them and not from when you sent the letter.

    They received my request on 13th march but they are trying the tactic of counting the 40 days from 2nd April when they received the request from Abbey in Bradford. Hubby told them they have to go by the date they request my letter and not Bradford, and they tend to back down. Jackie Scott at Abbey Data Protection sounded war beaten and reckon they are working 24hrs aday to cope with the amount of requests they have had over the past 2-3 months. hee hee they only have themselves to blame.

    check the number again its 08459724724 u have been putting a 7 where the 9 is. hope this helps, if so will u please check my thanks box. good luck

    I'm tryin to claim back £2335 from abbey, the court have given abbey until 24 april to give in their defence../so far nothing!!! What happens on tuesday 24 April if they still havent sent any defence? Im now getting quite scared!!!
    any advice ?????

    have just had a letter from the court , its a" Notice that Acknowledgmentof Service has been filed". what does this mean, do i need to do any thing.?

    I sent a Letter By Action on 18th April giving them 14 days to pay up
    (£17,00) or I'm going to start court proceedings, is it possible to go through the Financial Omb before starting court proceedings to see if it works that way or just wait and if it goes over deadline then start filling the N1 form.
