  • I wrote to Abbey on 3rd March requesting repayment of £838.95 (includes interest) and they sent me a couple of letters saying they were looking into it, then today I got a letter saying they were offering me £270 as a goodwill gesture. When I checked my bank account today, the cheeky sods had already credited it to my account.

    So, I assume my next move is to write back and tell them that unless they cough up the rest of it, I'm off to court? I'm in Scotland, so the procedures might be different.
  • The same thing happened to me. You could write to Abbey refusing that amount or write saying that you accept that amount as part payment without prejudice.

    I refer to default charges applied to my account amounting to£725.21 plus £51.60 which you have charged me in overdraft interest for the sum which you have taken - total £776.81 plus 8% interest totalling £838.95, which I have requested you pay back. I acknowledge receipt of a partial refund of £270 which I accept without prejudice. This reduces the outstanding total to £568.95.

    I wrote to you on 03/03/07 making the original request for a payment in settlement of my claim. As I have not received a satisfactory response I am writing to inform you I intend to claim the full amount claimed together with interest up to the date of judgement and court fees in the proceedings through the small claims court.

    This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the court will rule in my favour.

    I have attached a full schedule of the charges with this document.

    I look forward to a full response to this letter within 14 days, otherwise I will commence court proceedings to reclaim my money.

  • I would appreciate any advise or comments on this. I wrote my initial letter requesting the bank charges on 19th of march and heard nothing. Sent LBA on 3rd of April and was going to do MCOL on thursday giving them a few extra days because of the bank holiday.

    However, I have received a letter today offering £40 as a goodwill gesture. My claim is for £621 + £106 in interest. I have just phoned to tell them that I am still claiming for the rest of the money as I think the £40 is a pathetic offer, and that I will be applying to court on Thursday.

    The woman said under the FSA ruling we have 8 weeks to investigate this so do you want me to open up the second stage complaint for you? I said you will work to my timescale not yours, I have already given you 28 days to deal with this and you've come back with £40.
    She said " Can I confirm again you don't want me to open a second stage complaint which will take 8 weeks to investigate"? and I said definately not.

    I feel a bit shaken and scared now. Am I right in thinking I need to just get on with it and do MCOL now? Also the letter indicates it's a reply to my first letter so should I wait to get a reply to my LBA letter? Thanks in advance for any help.

    on the 25/02/07 i sent my first letter and £10 cheque to bank, i have received since then 14 months of statements. i contacted them today and asked about the other 5 years of statements and was told that i should receive them by the 12/05/07. now i thought i should have received all six years of statements within the first 40 days, if i am right is there someone i can complain to

    Hallo, my claim has taken a turn for the complicated.
    It hasn't helped that I moved home on the 23rd of March last month, and so there may be mail stuck in the letterbox of the old address (we did have it redirected, but there was a week before that started.)
    I sent the Step 3 letter on the 3rd of April threatening court action, and on Saturday I got a reply from the Step 2 letter, with Abbey offering £340 of my £1386 claim. I had closed that account in my local branch about 2 weeks beforehand.
    HOWEVER, I have just tried logging onto that account online to check it was closed - but it's not, AND they have deposited the £340 in there already!

    Now what? I've already sent the court threat letter for the full amount, so what do I do with this £340 sitting in my supposedly closed account! Argh!

    (I will be visiting the old address tomorrow to see if there's any word from my Smile claim in there!)
  • It looks like you will need to make a few phone calls.

    You could all try this.

    When they run out of time and you are all ready to send in the court papers. Try phoning your bank up and telling them that you are on the steps to the court and they have 1 last chance to settle, telling them they will save alot of money (court fees, interest etc ) if they settle now. I've heard this tactic does work. So if they do, remember to get it in writing.

    You don't lose anything by trying and it saves alot of time.

    I sent the 1st letter to Abbey on 15th March and I have recieved a letter today (a month later!!) asking me to visit my local branch with ID to change my address as I have moved since the account was in operation. They have also had the cheek to send me a ‘Request for Transaction Information’ form which states I have to send £10.00. THICKO'S!! I sent the £10.00 postal order with my 1st letter and told them what statements I wanted.

    So tomorrow i'm off to my local branch with my driving licence, a letter to the Customer Resolutions Manager including a copy of my original letter and the receipt for the postal order.

  • Hello guy's
    i'm now at the final stage of my claim and have a court date set for May 18th. I'm hoping that Abbey will not attend, if they don't do i still have to go through the charade of a hearing and present all my evidence or will the judge just rule in my favour by default ?

    Any advice welcomed as i'm a little nervous about fouling it all up at the last stage.
  • I sent Abbey all the usual letters (from the lovely templates)...and just get there standard its taking time and they want to sort it out...so i filed for the small claims court.....they intend to defend my claim "in full"....i dont really know what happens next so im waiting for something to happen...i heard abbey were one of the worst...anybody got this far or futher ?? i live in Croydon, but the court chosen was Northampton....do i have to go there
