    I would write them telling them You accept the part payment without prejudice but expect the balance within 14 days or will take to court. The without prejudice bit MUST go in there for legal reasons. I got sent cheques as settlement which I sent back but if its a goodwill payment straight into your account thats different. Just dont sign anything to say you settle! Good Luck

    £853 was put in my account in amounts of £30 and £35,and then a letter came explaining thats all they are prepared to give back.
    I was wondering if this had happened to anyone else at this point and what they did next.
    I'm hoping to get it all back, with out going to court.....but i will if need be.
    I'm going to write a letter tonight hopefully.

    HI everyone I am a newbie here and would like a bit of advice please. I wrote to Abbey in Feb requesting 6 years statements of charges, received last 12 months statements surprisingly quickly, then a letter a couple of weeks ago acknowledging my £10 payment and stating that I would get the rest of the statements (microfilmed copies) shortly.(cheque cashed 2 weeks ago) The 40 days were up a few days ago and I phoned yesterday. The lady on the end of the phone "made a few enquiries" and acknowledged that as per Data Protection I should have received these statements by now but due to a "large amount of similar requests" there was a backlog, but nevertheless I should receive the statements shortly. Should I just go ahead and report to the Information Commision anyway, or hang in there for a few more days?? also has anyone had their accounts closed by the Abbey after winning back charges?

    Just wanted to say to keep going with your claims! I've just received a cheque from Abbey for £400!! :oD I sent all the letters and filed a claim on Moneyclaim Online. They offered me exactly 50% of the amount I was claiming (£512), to which I replied saying I would not accept the amount they were offering but I would accept £350 plus the court fee of £50. Abbey accepted this by sending the cheque! I had already received £50 as a goodwill offer which I accepted as part settlement. The original amount I asked them for was £422 (the amount the charges actually added up to without interest), so all in all I received more than they had from me!! Yay!!

    So, even though Abbey is a tough nut to crack, they do eventually, just keep the pressure on!

    Good luck, don't give up and don't let them get away with YOUR MONEY!!

    I'm at the stage where i've got to send a letter to abbey saying that i will accept the money that they have just put back in my account...but only as part payment to the full amount and without prejudice etc.
    I'm not to sure on wording it, but i want my money back and seeing other people win only spurs me on more.
  • can anyone tell me what a manual intervention is ?
    Abbey have sent me the last 14 months worth of statements, but have said that the previous 5 years are stored on microfiche and therefore are not available as a computer printout, but that they will send me a list of archived transactions.
    they then say.

    With regards to `manual interventions` that may have been made on the account. We consider `manual interventions` to mean an action that is not computer driven or automatic. Not all `manual interventions` are recorded, for exampleif a member of staff looks at a paper document relating to an account, a record is not always required. Similarly some intervention may relate to work carried out by a department rather than individuals where no central record of activity is kept because this is not the kind of information we need, or more importantly, that a customer would usually request.

    I`m not sure what this means, they still have about 10 days left to provide all my statements, should I wait till then and then write a ltter threatening to report them to the information commissioner or do you think i should contact them now and ask what this means.
    Also do they have 40 days to provide my statements from the date of receipt of my letter or from the date of the letter of confirmation that they have sent me ( which is dated three weeks later ) ?

    Any help would be appreciated.

    did you keep a copy of the letter asking for statements?

    if you did i would write a new letter of complaint to the "Financial Ombudsman" including a copy of your staement request letter and thier response, the Ombudsman has the power to force them to disclose the infomation and (refund when you have the total).

    Send the bank a copy of all the letters you have just sent to the Ombudsman.

    that should give them the kick up the !!!! they need!

    basically from now on copy the ombudsman on everything you send to the bank and more importantly, make sure the bank know you have copied the ombudsman.

    i have had £1100 from natwest, £200.00 from capital 1 , £200 from barclaycard and am now pursuing nationwide and barclays bank

    I had exactly the same letter.
    At the last minute i recieved a large envelope in the post with print outs of all transactions.
    the charges are defined on there as CHG.
    They just talk a load of rubbish to try and confuse you, but they know what we mean really.
    Hope you get them soon!
    I am just about to put in a claim for £665 inc interest.
    Look atfer the Pennies and the ££££'s will care for themselves :money:

    If you have problems getting your information/statements its not the FO you need to contact but the ICO as below....

    Always check if you can download statements with online banking and/or camp outside your local bank :)
  • Firsty..Hi I'm new to all this so please bear with me!
    Sent the Abbey Nat the 1st step letter to re claim bank charges!
    Got a reply saying they will look into it ....could take 4 weeks!
    4 week deadline was up today....got a letter in the post this morning apologising for the delay, our complaint is important to them...blah blah......they are still looking into it and it will take another 4 weeks!!
    So my question is...do I allow them another 4 weeks or do I send off the 2nd letter threating to go to court if they dont settle?
    Any advice would be appreciated. thanks
