    well i done it i went to my branch today after calling yesterday to see where my statments were as its been 2 weeks now and i was told they would be with me in 7 days and they said on the phone that it would take 8 weeks for the older ones to come but the more resent ones should be with me in the next 7 days. so i said that it wasn't good enough and that i didn't want them now if it was going to take that long (they did't know that i'd already found all my charges now and didn't need them.) for me to get them so i asked for my money back and they said i would have to go to the branch as it was cash. so i did today i told the girl what had happened and she said ok i can have my money back but as she didn't know how to refund it could i wait till mon or tue when the manager was in and he would put it in to my AC.

    one up to me just got to see if i can get the £480 out of them as quick but some how i think not.

  • I am now in a position with a new bank a/c set up, to pursue Abbey for 6 yrs of charges. A friend tells me that there may be, or have been, a time limit for making a claim. Has this time passed? Or can I still start a claim ?

    youd be better off just getting it over with.
    Save saynoto0870.com in your favorites, and stop giving companies more £££ dialling 0870 numbers when you can dial freephones or cheaper alternatives
    call your credit card company, tell them that you want to leave, 99% of the time theyll lower your APR%
    Remember when that Bank Manager or Salesperson smiles at you, all he sees is £ notes. Dont forget the motto, "the wider their grin, the more debt your in"

    See what I mean. If you try and play fair with the Banks they'll treat you with contempt alongside letting you hang in the wind.

    If you want youyr money back, and all of it the only solution is the following -

    1. Write letter 1 giving them 2 weeks to pay back or court
    2. If you receive a letter back from them saying 'thanks, we're looking into your claim and will report back in 4 weeks etc' send them another letter saying they have another week to repay the money in full before you take them to court, and you will have no further warnings.
    3. If you don't receive a letter back from them write again saying they have 1 week before court, no further warnings.
    4. If nothing back or even a partial offer take them to court after 1 week.

    It really is as simple as that and if you're not prepared to go to court and carry out your threats then I personally wouldn't bother trying to reclaim any money as you're wasting your time.

    And make sure all these letters are sent recorded.

    have just taken abbey to court and am now waiting for them to send in their
    defence. They have until 24 April. So hopefully i will get some of my money
    back!! Will let u know how it all goes.

    Do nothing and wait until 2 weeks before the court date. Then send them thins letter -

    CLAIM NO: XXXXXXX

    Dear Sir or Madam

    Over the last week I have been busy preparing my arguments alongside gathering facts for my court case against Abbey which will be held in XXX on the XXh XXX 2007 at 11.30am.

    However, when looking at your defence as stated on the allocation questionnaire that was submitted I note that it is word for word the same defence that virtually everyone who is suing Abbey for settlement of unlawful bank charges has received.

    As I believe that Abbey has not successfully used this defence in an actual court hearing I would like to offer you the chance of settling out of court if only to save you time, and Abbey’s legal budget money.

    I look forward to your reply but if you do want to take the matter further then I very much look forward to seeing an Abbey representative in court at the beginning of next month.

    This should force them to pay up before you have to worry about preparing any sort of defence.

    If you don't hear from them by 3 days before your court date start preparing your defence, it's easy to do - the bank charge websites tell you all you need to know.

    My bet is that there's a 95% cance they'll cave in before the court date.

    But whatever you do DON'T settle for anything less than the charges + Interest + court fees. You have given them plently of opportunities to settle for a smaller amount and they didn't want to so they must pay up in full otherwise you'll see them in court.

    Abbey's 14 days are nearly up to pay back the £1,711.00 they owe me. I've prepared the letter to go out on Wednesday 18 april (as they have already sent a letter stating they need 4 weeks to investigate)

    I have added paragraph from martins templates 'without prejudice' that I will settle for £1,600

    I know they won't but at least I've tried. I don't want to do the court bit as it looks like alot of preparation i.e court bundle/notes etc and the fear of not preparing well to jeopardise the case.

    Well they have 14 days before I submit a claim on line. Anyone going through the claim stage at the mo?
