    Hi,

    Just wondered if anyone could help. I have got to the Moneyclaim Stage and Shabbey are defending the claim. After two letters from them saying their charges are legal etc etc and no refund will be given, however a goodwill £50 was credited to my account which I have not spent! (I am claiming £1078)
    I have now received a letter from Shabbey, asking me to forward a copy of all my interest calculations and breakdown of charges etc! Which they have had twice.

    Do I ignore or send this stuff, I'm a bit peeved off now, as I started the process back in January.

    Any help would be appreciated.

    I'm at exactly the same stage as you. I received a second class stamped letter from their representatives on the 10th April and replied back yesterday.

    With the letter I sent back yesterday I attached a copy of the initial letter I sent with the schedule breakdown - it's important to be entirely complicit so that the courts and banks can see that you have helped.

    What I also did was send a copy of my reply as well as a copy of their letter (I noticed that they hadnt cc'd MCOL) to MCOL, and let Abbey know I'd done this, just so that they have a copy of any subsequent communication between ourselves, and also so that Abbey know that I know what I'm doing.

    For info, this is a copy of the letter I sent:
    I acknowledge receipt of your second class stamped letter dated 5th April. It was delivered to my address and opened by myself on the 10th April.

    In response please find attached the letter I sent to Cahoot on 31st January 2007.

    This letter comprises the answers to your (ii) and (iii) requests, i.e, a schedule of charges by date and amount, and details of how the interest is calculated in reference to each charge, in addition:

    i) My account number is at the head of this letter

    You will also find my phone number and email address at the head of this letter.

    For reference I have also sent a copy of both this communication and your own communication to the Court Manager.

    28 days is not acceptable as you have given them 14 days. On your day 15 send them out the next letter telling them you will be taking them to court if they don't respond in 14 days.

    Ok so I sent the first letter giving them 14 days and they sent me that one today.Should I go ahead with the second letter now??
    Im sorry if I am being a pain,I just want to get it right.

    Also received letter today from abbey, from andrew nanson, with a complaints form to fill in. They'll then contact me in four weeks to to let me know what is happening.
    Tomorrow a second letter will be going recorded delivery, to ask for my charges back or legal action will follow.
    Am a bit worried about taking legal action as hve never done anything like this before any advice would be appreciated.

    Hi abbeys 40 days are up on tomorrow do i send the next letter out tomorrow if there dont come in the post i dont now what to do thanks
  • Hi, this is my first post so please be gentle wth me! I have filed a claim against Abbey and have today received a letter from them with the defence they are going to file, this has really unerved me and I am now feeling,well scared!! It states that I had been sent on several occasions copies of their rules & regs regarding going overdrawn etc and that they dispute the amount claimed. Feel like I wish I'd never started this. Any advice gratefully received.

    Sounds like a standard defence. Nothing to worry about. Are the disputing they whole amount?

    Good evening all,
    Today I got a reply to my second letter and I now have £853 in my account.
    This is far less than the abbey owe me ( £3068 ). Abbey have offered £853
    as a gesture of goodwill !!! I will except this, but I want the rest of my money back too.:mad:

    What I'd like to ask you all is,
    Do I write to the abbey again asking for the rest of the money ?
    I'd also like to know if there are any template letters that I can use to help ask for the rest of what they owe me ? ( I've not seen any letters for this )
    Or should I start the court action ?

    And I'd like to thank everyone who's helped with advice so far. thanks.:T
