    They do tend to get sent out in batches but I would phone them now and point out the 40 days is almost up and you will be reporting them to the ICO.

  • Hi all can anyone tell me whats next? i am claiming £3,000 from the abbey and we got a letter nearly three weeks ago now saying they will get back to us in 28 days!Can we expect good news or bad?

    I need some advice please regarding my old closed Abbey current account. I'm claiming £400 and have sent two LBA's. Just got a letter from Abbey saying they've carried out a full investigation and they confirm that charges were applied correctly as I had insufficient funds in my account and they are unable to agree to a refund any of the charges applied and that the charges do not contravene the Unfair Terms in Consumer Contracts Regulations 1999 blah blah blah.

    Shall I make an on-line claim now?? Has this happened to anyone else??

    Hi all,

    First the background in case it's needed;

    I kept all my statements (I have going back about 6-7 years or so) so had no need to request details from bank. I've been following the guide on this site for letter templates etc.
    • 7 March 07 - Sent first letter recorded delivery quoting 14 days for reply
    • 12 March 07 - Received standard letter acknowledging receipt of my letter with a guide on how complaints are handled.
    • 27 March 07 - Sent second letter recorded quoting 7 days for reply. 7 days was meant to be 14 but was left as 7 by mistake by myself. Given bank holiday weekend, and that it is difficult for me to get to a post office on most days, it has now been 14 (calendar) days anyway. No response received to this one, not even an acknowledgement.

    I am assuming I am now ready to move onto the court level of things.

    My query is regarding the fact that I was charged again during this time and if I want to claim this charge as well, am I safe to file with the court for a figure higher than what was quoted in my letters? I will only be claiming against charges to my account of course, and not more than what was taken from me originally.

    Yes. MCOL ask for the new total but you should try to avoid charges during this process to make it less complicated. Good Luck

    Hello everyone just got the phone to abbey and they told me i would have to wait another 4 to 6 weeks before the rest of my statments come through i told them that they have had 40 days to send out my statmentsand if dont have them by the 13th april i will be sending them another letter she apolgised and said they will be sent out to day i hope they arrive they are getting cheeky now

    what letter do i send if my statments do come please help

    You need to prepare a list/spreadsheet of your charges, use the Interest Calculator in Martin's article and send it with the first template letter asking for your charges back. Check the Reclaim Help Thread linked in my signature and of course read Martin's article and follow the steps there...
