    Started court proceeding today againt the halifax to claim back charges of £2070.00. slightly worried i have had to get to this stage as from reading other threads the Halifax have always seemed to pay out before it got to the court stage.
    wondered if there was anyone elso who have had to go as far as court with the halifax and what happened??? cheers
  • When I received all my statements from Abbey they said in their covering letter that, although I hadn't asked them to, they had identified my Abbey Credit Card number (closed account) and had requested MBNA to provide statements from that account.

    So, about a week later I received statements separately for my old Abbey Credit Card - the covering letter was on Abbey headed paper.

    Question is ... do I claim the charges on the Credit Card from MBNA or Abbey?

    I have included it in my letter to Abbey, but having read MBNA threads I'm not sure that's correct?

    Any advise anyone?

    Would like some advice please.

    I started my claim against Abbey last year. Sent them a letter which they replied saying they was investigated. In December £675 was refunded into my account. They still owe me £1448.

    Unfortunately I have been a bit slack and too busy working shifts and not be bothered to chase them for the remainder.

    Do I still stand a chance of getting this money back? I want to use it to pay my overdraft off and feel much better!

    If I do stand a chance do I just send the next letter of saying thank you for the payment but this is not all the funds you owe etc. blah blah.

    Any advice would be greatly appreciated.:T
  • My advice to you would be to pursue it. However, if you have already written to them confirming that you accept their amount then you might have stuffed yourself. I am assuming you didn't though, in which case just because you haven't chased them, doesn't mean you haven't forgotten about it. Although I am assuming they are hoping this is the case.

    Got a question for you. How far did the statements go back? I am in the process of requesting mine from Abbey and they have only offered the last 14 months as they said the rest is on microfiche. Did you have this problem?

    We received the usual fobbing off letters from Abbey today saying they were investigating our complaint and will write to us in 4 weeks to let us know what is happening blah!!! blah!!! blah!!!!

    I take it, from reading some of these postings, that we should let them have the 4 weeks to investigate, even though we gave them 14 days, or was the 14 days just to reply to our letter requesting they pay us the cash???

    I'm also a bit concerned because from our joint account we will be trying to get £5400 back and I belive this is above the threshold for claiming through the small claims court?? My wifes account is easier as we are only claiming £1750 back, how do we go about claiming the full £5400 back, or should I wait for 4 weeks and then send them another letter saying we will accept £5000 if they settle straight away??

  • stick to your timescale - not theirs, i had a letter saying it will take 4 weeks to investigate, their just time wasting
  • Just had the court date for the 28 June 2007, I started this in Jan/Feb????? It seems an awfully long time this has been going on.

    Abbey say they are going to defend. My claim letters (for £1500 ish) were based on estimated accounts (I didn't have all the statements - still don't), although I've paid my £10 for them, still not arrived so I put in a complaint.


    Has anyone won money from Abbey?

    Are they capitulating and paying up?

    Hi everyone

    I sent my 1st letter to Abbey for charges (without interest) and have now received a letter saying they will look into this, I also recieved a leaflet about complaints. They state they will respond in 4 weeks. Do i give them 4 weeks or should I send another letter before then.

    Sorry I know I should be following what is happening, but what is the timescale for them to respond and which letter do i send next? I have tried to read through all the messages but I get confused. Sorry please help. :)
