    I made a claim for unfair charges of £2557 to the Abbey.I have just recieved a letter saying that they are satisfied that the charges do not contravene the Unfair Terms in the Consumer ontracts Rregulations 1999 but, they will refund £785 as a good will gesture, does this affect my claim as i'm not willing to accept such a small payout, and also by them paying me are, they admitting to the charges.Please could someone help me with my next move?

    If they have already credited you with this money you need to write and say you will accept it in part payment only and without prejudice but will be continuing to court for the remainder.

    If they haven't already paid you do keep an eye on your account as they may well just credit your account.

    This shouldn't be a problem as they don't do a credit check on these accounts, nor do you need any money to open them. I have gone with Natwest for my salary (personally find SOLO is much more popular and more widely accepted than Visa Electron) and the Halifax for my Child Benefit/Child Tax Credit. Opened them both within a week of each other and have had no problem whatsoever.

    At the moment I'm with the Woolwich (just a cashcard account) but will be closing this as I don't want to deal with Barclays (although they're all robdogs at the end of the day!!!). Claiming just over
    £2k from Woolwich, £500 from Capital One, have requested statements from the Abbey - god only knows how much I paid in charges to them! :eek: Oh, and then there's Black Horse......

    CAN anyone tell me though (I have already lodged my claim with Moneyclaim).

    Can I change/ amend my claim to charge £5 per letter I've sent, and an amount for each time (not often) that I've had to ring the ShABBEY in relation to this.


    Or am I not allowed to amend / add to it once submitted?

    I really would like to kick the ShABBEY in the proverbials after the way they've treated me and the many other people!

    :cool: hi i got my list my charges which covers all charges going back january 2004 the summary records the numbers of charges, their description and toatal in each calendar months.any refunds and reversals of charges are also listed and the totals are given at the end of each column. do i just add up the total of unpaid standing orders and and the rest of the charges you can claim back some one please help please thanks kathryn

    I added up,
    1) Any transactions paid whilst not enough in my account
    2) any bounced cheques,
    3) Any direct debits they refused to pay
    4) Charges for going overdrawn.

    (basically, I added up any columns they had put charges in) then deducted any refunds they gave me (which werent many) to give me a total of what they owe me so far.

    Seems we are at the same stage, hopefully we should receive the list from before Jan 2004 very soon in the post, otherwise I will be sending them a letter as their 40 deadline was up today.

    Hi all!

    Not been on here for a while as i have been waiting for Abbey's defence (figuring from past posts on here that thats what they'll do, and they have!)

    They sent it on the 12th April and than i got a letter from the Northampton court saying that it was being transferred to my local county court, and they included a copy of Abbey's defence.

    My mind has gone blank now though cause i can see my refunded money at the end of the tunnel (all quite exciting really!!) but i am really nervous now as to
    1. what to do next!!

    and 2, Making a mistake in what i need to prepare for the court bundle and documents that i need, as i am thinking a date will be set soon! i'd hate to lose on a technicality, although i do have copies of every letter sent and also what they sent me, and my list of charges.

    Any advice from anyone would be GREATLY appreciated.

    Although Twinkly and Andypez, you guys have been great help to me in the past, what d'ya think?





    On another matter: Claimed my charges back for my credit card with Capital One too (£316 without the interest although most of these were £12 charges, some where £20) Got an offer of £88, not officially accepted yet but unsure as to or not as my card is only £200 limit and i cant really afford to pay another £120 to take them to court too! not sure what to do on this one!

    I can vouch for this info, i have step account with Natwest and i have never had any trouble with the solo card being accepted anywhere.

    Hi again!

    Sorry about the bombardment of posts the last hour or so, but i have just registered on the CAG website for help on the Allocation questionaire bit.
    Does anyone know, should now phone my local court tomorrow and ask for an AQ to be sent to me? Is that the next thing i have to do?

    Does the letter say you will be sent an AQ or has this bit been scored out. Generally the AQ will be posted out with the defence but some courts are dispensing with the AQ now.

    We're in exactly the same position and would like advice too please? What do we have to prepare as a court bundle? Is it just all our copy statements with the charges highlighted? or is there more?
