Mine tend to come out between 6 and 9th of the month, so I have chosen to use the 9th on the months that they havent put dates on, that way they cannot accuse me of trying to get more interest out of them.
I also sent them a non compliance letter and pointed out that they hadnt supplied me with the date the charges came out for Jan 2004 to Dec 06.
I have also filled out a complaints form to the ICO just in case they dont send them to me within the next week (still waiting on 02/03) in the letter i have also complained that Abbey know that we need the exact date to calculate the interest, for when it gets to court, and they are not providing it to people.0 -

I sent them letter template 2 and said they had 7 days but during that time they only sent me 04/06 and said if i had my account before 04 these statements would follow.0 -
I'm claiming for a total of £425 against Abbey who originally acknowledged the claim and have now put in a defence against my whole claim. I have been informed that this can not continue online and will be dealt with directly by the county court.
Is this another delaying tactic or something else?0 -

I am claiming £2750 from Abbey...They offered £1,008 which I refused (as I had already started Legal Action via HMCS
I recieved notification today that they are going to defend the full claim (which gives them 28days) and when I checked my Bank Account, they have refunded the £1,008 which i had written to them about, refusing it, and going for the full amount!!
Here is the pinch!
A direct debit has come out for £55....which has eaten into the £1,008 which they refunded!!!
!!!!!! do i do now? (apart from Panic!!)0 -

This is the letter i sent them. Hope it helps regards julie.
I am in receipt of the documents that you have supplied in response to my Data Protection Act Information Request dated xxxxx (and received by your office xxxxxx via recorded delivery). The disclosure of personal data is incomplete in that at least the following documents are missing.
1) You have failed to provide a complete list of transactions and charges for the period from March 2001 through to December 2003.
2) You have failed to provide details of the exact dates the charges were taken from my account for the period from Jan 2004 through to December 2004
This is not an exhaustive list by any means, it is just an example of some of the information I am missing.
Accordingly, I have to tell you that you have not yet complied with your obligations under the Data Protection Act 1998.
The time for compliance with my request has now expired. If you do not comply fully with my Subject Access Request within 7 days, I shall apply to the County Court for an order to enforce compliance, together with damages at the discretion of the court. I will also be making an official complaint regarding this matter to the Information Commissioner and the FSA.

I have just found out from the court that my back has notified them they will be appearing on the court date. The bank made no attempt to offer me anything before this. Any ideas of what chances I have with this?0
