Has anyone filed a court claim after the bank has paid the difference of the charge and brought it down to £12 wich the OFT says is the correct amount. I was owed £220 but Capital One have paid £88 and im now owed £132. Would a court claim work?0

OFT has recommended the £12 as being fair for credit card charges, however you can still claim back the difference. If they are saying the £12 is a "correct amount" for bank charges then they are wrong.0

They have already paid back the difference so do you see me winning in the court to get the £12 charges back?0

hi, if it's unfair charges, then have a go, it all adds up & better in your pocket than theirs.
they have had our money for long e-nuff.
read the article, it says you can try & get interest on the unlawful charges, but i wouldn't have thought you would get the interest back you have paid on the overdraft, maybe i'm wrong, does anyone know different?0 -

The OFT said that just because a bank charges £12, it does not make this a fair charge. Only a court can decide if the charge is fair or not. The CC companies have been paying out claims rather than testing this in court, so we don't know what a judge may think. How many surrealists does it take to change a lightbulb?
