Hi everyone,
I am about to request my last 6 years worth of bank statements from the HSBC to attempt to claim my bank charges. However I have a problem.........
I am in debt with the HSBC with a credit card, loan and my old account.
My overdraft on my current account was £400, the account has now been closed and on the account alone has a outstanding balance of £1700, this is with all the charges they have added on. I now have a default on this account.
When the account was open, I was always getting unfair charges and i always ended up paying them.
I was wondering if anyone knew how i would stand on claiming them back?
Would they take the amount off the debt I owe them????
Would I get the charges back for the times when my account was active???
Hope someone can help.

You can claim on a closed account however as the account is in debt any successful reclaim would be paid into the account to reduce the debt.
You can claim back 6 years from now rather than 6 years of while the account was open.0 -

I think you need to read Martin's article regarding claiming as one of the reasons of taking it through small claims court is the costs are minimal.

Does anyone know wether you subtract the £12 banks are allowed to charge when submitting a claim or whether you claim for the full amount of the charges?0

I need some help. I have just got my bank charges back from the halifax £927. I'm now going for the credit cards. I called them today asking for my statements etc and was advised by the operator that i would be charged £5 for each one. In total £200. Is this correct? I said i'd look into it and get back to them. Can anybody help?0

Now i know i'm thick i keep sending the message to myself!!
Hope someone can help me with these 2 queries.
I am claiming £2095 +£525.88 interest a grand total of £2620.88 They offered £1000 in a letter then £1200 over the phone but i said no deal.
I am now filling in the Moneyclaim form online.
Q1 the defendant is obviously Barclays, do i have to put their head office address in the defendant box, the address of the branch where my account is or the address on the last letter i received from them which was Barclays Retail Customer Relations in Swansea?
Q2 In Martin Lewis's example "Particulars of claim" No4 where it mentions the interest. Do i put the £525.88 interest which was worked out on the online calculator. The in No5 it says "insert total charges" plus interest ammounting to a total of "insert total charges plus interest"
I never was any good at maths but find this abit confusing. I imagine the 0.028% is left out of the equation for now as i guess the bank has to add that on at the end if they loose.
