    One letter and one cheque for £10 will cover your letter asking for info/statements. However, do your claims separately especially as one account is overdrawn as any reclaim will be paid into your account.

    If the bank should close your account or withdraw your overdraft they need to give you 28 days notice, I think.
  • Hi to you all. A work collegue told me about this site after we were talking about charges made on my account by the Halifax. Anyhow, I downloaded the template letters and handed in the first letter to them yesterday (10/02/2007). I'm in the process of trying to open up an account with the Alliance & Leicester, but I think that there will be problems with opening up a new account with them.
    Can anyone let me know, what the next step to take regarding Halifax and if Alliance & Leicester refuse me, what then? :confused:
    Don't worry both barclays and A & L offer basic accounts which do not require a great credit rating - look into one of the links on this website for current accounts.

    I've been reading about the bank charges and have decided to try and see if I can get my money back! For some time now they have charging me, and my dad's amazed with how much they have taken from me!

    The only doubt I have is in my past I have been quite overdrawn but I do not know where the line is between a charge being extravagant and being justified. Should I include all charges and see what they will put their hands up to them being too much? The bank involved is LloydsTSB... are very willing to pay up?!

    Any advice will be gratefully received!

    Hiya..Im In The Same Boat..I Was VERY Stupid, I Didnt Even Have An Overdraft Yet I Went Overdrawn Countless Times And I Knew What I Was Doin!!

    Still, IN One Month They Charged Me A Grand Total Of £185!! I Couldnt Believe It!!

    Im Sending My 1st Letter To HSBC Tomorrow, And Including ALL Charges..

    At The End Of They Day What Have You Got To Loose..? I Say Go For It And Put Down EVERY SINGLE Charge..

  • By all means claim all of your charges but please do be sure they are correct charges by reading post 4 on this thread.

    It doesn't matter how bad you have been in the past. You are disputing the level of the charges applied to your account because these do not comply with UK law. You reclaim all the charges the bank have taken from you.

  • I was talking to my sister about reclaiming charges yest and she said that the banks etc were near to changing the law to stop people reclaming the charges. She said had heard it on tv!!

    Has anyone else heard this? I am now worried as I still have 30 days from 5 companies to get statements before I can put a clam in so this could all e a waste of time.

    Can anybody help.

    Am all ready to submit my case on moneyclaim.
    However, if i have'nt done something right and they just chuck it out of court due to some error on my behalf, can I just re submit it or have i lost the case altogether? ( I know I will have to pay £120 again). I just dont want to end up not being able to take them to court because I fluffed the case up.

    Here are my claim particulars (taken from the forum).

    1. The Claimant has an account xxxxxxxx with
    the Defendant, opened 29/04/02. 2. Since
    02/08/02 the Defendant debited charges and
    interest in respect of purported breaches of
    contract. 3. Defendant is aware of all
    details as a list of charges has already
    been supplied. Another copy will be sent. 4.
    Claimant contends: (a) The charges exceed
    the Defendant's losses caused by the
    breaches; (b) The Term permitting the
    Defendant to levy such charges is
    unenforceable under the Unfair Terms in
    Consumer Contracts Regulations 1999, Unfair
    Contract Terms Act 1977 and at Common Law.
    5. Claimant claims: (a) return of the
    amounts debited of £3114.70; (b) Interest
    per S.69 County Courts Act 1984 of 8% -
    £551.98 continuing at 8% until judgment or
    settlement at a daily rate of £0.68; 6.
    Alternatively, if the charges are a fee for
    a service, then they must be reasonable
    under S.15 of the Supply of Goods and
    Services Act 1982. 7. Costs allowed by the
    Court.

    Since when did banks start changing laws? This doesn't sound correct, do you have a source?
