    Hi, I sent for my 2 statements from citi & got 2 made up spreadsheets which look to me cobbled together & not a true reflection of our accounts. If i post them & my reply on here will someone, preferbly Edinburghlass or Rex_Mundi please take a look & tell me what you think of the statements & also if my reply is ok to send. Thanks guys. SUFC

    i have just tried that calculation and it came to £3.44 interest worked ok ...sorry don't know why it wouldn't work for you hun

  • Can anybody help.

    Am all ready to submit my case on moneyclaim.
    However, if i have'nt done something right and they just chuck it out of court due to some error on my behalf, can I just re submit it or have i lost the case altogether? ( I know I will have to pay £120 again). I just dont want to end up not being able to take them to court because I fluffed the case up.

    Here are my claim particulars (taken from the forum).

    1. The Claimant has an account xxxxxxxx with
    the Defendant, opened 29/04/02. 2. Since
    02/08/02 the Defendant debited charges and
    interest in respect of purported breaches of
    contract. 3. Defendant is aware of all
    details as a list of charges has already
    been supplied. Another copy will be sent. 4.
    Claimant contends: (a) The charges exceed
    the Defendant's losses caused by the
    breaches; (b) The Term permitting the
    Defendant to levy such charges is
    unenforceable under the Unfair Terms in
    Consumer Contracts Regulations 1999, Unfair
    Contract Terms Act 1977 and at Common Law.
    5. Claimant claims: (a) return of the
    amounts debited of £3114.70; (b) Interest
    per S.69 County Courts Act 1984 of 8% -
    £551.98 continuing at 8% until judgment or
    settlement at a daily rate of £0.68; 6.
    Alternatively, if the charges are a fee for
    a service, then they must be reasonable
    under S.15 of the Supply of Goods and
    Services Act 1982. 7. Costs allowed by the
    Court.

    Have counted it several times and it seems to fit all criteria.

  • i have got as far as requesting last 6 years bank statements from HSBC..... it will take 40 days to send this information out to me. Is this the start of major stalling techniques :(

    I'm guessing that they have compiled all the info rather than send you statements which they are allowed to do as that is what you are asking for under DPA. Do you think the amounts are wrong?

    Hi there,

    I sent my first letter to NatWest requesting back £971.43 bank charges (including 8% interest) of the last six years on 24 January and I received a reply by them on Friday where they are offering me back only £619.00, but I'm not going to accept this and will send the next letter giving them 7 days to give me back the full amount. My question is: if I would recalculate the interest now the amount to claim would be higher since it's been two weeks after the initial calculation (also there has been another charge in my account while waiting), so the amount I would claim would be higher. Should I recalculate and ask for this second amount in this letter or do I stick to my original request?

  • The bank won't include the interest in any offer as they don't have to unless it reaches the court stage.

    Once it reaches the court stage and you are filling in the details on MoneyClaim you would then recalculate the interest charges to bring them up to date.
