No, you can't claim back the interest you are charged for going overdrawn, have a read of this thread for the list and an explanation of the interest.

Well started the process with 2 accounts with barclays and one with the halifax
Account 1 Barclays =£1037.97 inc interest
Account 1 Barclays= £818.13 inc interest
Account 3 Halifax = £ 2601.93 inc interest
Barclays sent the £10 cheque back as a good will gesture, Halifax cashed it!
Barclays have 7 days now to respond to my letter then I'm going directly to fill a claim. I've just finished the letter to Halifax and then will wait for 14 days but then also apply to court.
I have never done this before but in December they charged me £90 on 16th, £30 on 17th and then a further £90 on the 18th.....incredable they then this month charged me for for going over the overdraft.......I AM NOT BACKING DOWN. I have already opened an account with A&L. All the money will pay off my overdraft, my flights for our family holiday in August and some spends to boot....bring it on!!!0 -

My first time - woohoo! If I have repeated someone elses question, please forgive me. After trawling through the first 10 pages, I realised that it'd take weeks to read all 98!
In a nutshell, I sent the initial letter (request for list of charges) on 23/01/07 and LLOYDS have until 04/03/07 (a Sunday, as luck would have it) to respond. However, I have read through Martin/s comprehensive guide with the template letters, but cannot find what the next step is should banks not respond to the initial letter. He does suggest contacting the Information Commissioner's Office and follow up with a telephone call to the bank.
My query is...do I just sit back and wait for LLOYDS to either respond to my phonecall (assuming they do not respond by 04/07)? Or I have to contact the ICO, do I just wait for them to force the information my way? I havelooked at all the next template letters to send and they are all devised around the assumption that the initial letter has been responded to within the 40 day period.
Help! And thank you in advance!

You need to give them the 40 days to respond with the information you asked for. If they don't comply within the 40 days you can then complain but until that time there is no point in worrying about how to complain if you don't actually need to complain
You can always phone if you feel its getting near to the 40 days without hearing anything.0 -
i am 43 years of agfe and have been with the halifax since i started working at 16, things have been topugh for the last 5 years since my husband died and a few months ago my hours of work were reduced. anyway! needless to say that despite my trying to manage my current account well i have at times been hit hard by charges even though the defecit regarding direct debit has only been 23 pence , in october they hit me for £38 x 3 and then £28 for unauthorised overdraft usage all requiring paying in that one week! i got short thrift when i rang them to explain that charging me like that wasnt helping my situation and that how are people supposed to catch up with themselves in situations like that,im not ashamed to say that i begged them to reconsider but they flatly refused. in 5 years i have estimated that halifax have charged me £939.00 (without adding interest) i have been aware for many months that people are challenging thse costs but it was the halifax,s attitude to my situation that spurred me angrily on to start the cycle of reclaiming them back, i requested all my statements going back 6 years but they were a long time coming, i rang twice and the operator was terse and curt when i explained what it was i had requested, when they sent me the statements they stipulated that as afar as they were concerned the case was then closed, however i wrote giving a detailed breakdown of all the charges made and requesting a refund, they replied immediately stating that customers are aware of their terms and conditions when they join the bank and that customers have entered into a legally binding contract with them from the moment they open an account and so therefore wont be refunding the charges as they are the halifax,s standard levy,s and therefore have done nothing wrong, yesterday i wrote informing them off my intention to persue this through the court and persue it i will. i will let you know how i get on, i must say though that it is very encouraging to read of the success stories, its a huge and scary process im on now but i will persevere until the end.good luck everyone!0

Hi there I am trying to make a claim with the Halifax and they have so far explained it is not unlawful blah blah.. and they are trying to direct me to contact the Personal Customer Complaints dept. Should I now write to them with my threat of cout action or should I continue to try to claim through my branch?
Also the 2nd template letter asks you to name the court that you will be using, do I have to find a local court or is this where I would name Money Claim online as my choice.

This is a standard letter from the bank so carry on with your next letter.

Does anyone know why when I use the interest calculator the figures from april 06 have minus eg on a charge of £50 it says £50 16/04/06 -£0.56 total £49.44
any ideas anyone
