    was wondering if anyone could give me some advice please?
    i sent my mcol off on 17th april,it was served to the halifax on 23rd april,who acknowledged it on 2nd may and now have 28days to defend
    received a letter off halifax yesterday saying sorry youre unhappy,but our charges are fair and you knew charges when you applied for account blah blah blah,and that they are declining my complaint and if im still unhappy to get advice from the financial omsbudman service?
    so am i being fobbed off? or do i still go ahead with taking to court?
    am so confused on what to do next so any advice would be greatly appreciated :o

    £215 charges
    £70 intrest

    I went through all the stages,1st and second letter then took it to mcol just checked my account this morning and all the money i was asking for has been deposited in my account minus 2 weeks interest, However,i amstill down on the £30 it cost me to start the claim with mcol, should i ask for this back in a seperate letter to halifax or should i let the claim continue with mcol and then let them deal with the whole problem( the extra interest and the £30 for mcol?)

    I have just recfived a reply from Halifax Saying the have turned down my complaint and i have no claim to reeclaim my bank chanrges! does this mean there is no point taking them to cort? please help.
  • Hello. I'd be very grateful for some advice on the following.
    I've read the info on statutory vs. compound interest, and am wondering if there is justification for charging the latter...

    As briefly as possible, last September I was £493 OD with a 500 limit, and was stupidly one day late in cancelling a few DDs. They all bounced, and the charges of £38 per DD took me well over my limit. Since then I haven't used the account and Natwest have charged me £28 fees per month, plus interest of £15 in Sept 06, rising to £25 last month. I'm now £1100 OD. Would I be justified in charging compound interest for the £600 ish that they are 'responsible' for?

    Additionally, I've written to HSBC to claim back charges they levied, and they wrote back 3 weeks ago saying they are looking into it. Does this constitute an unsatisfactory response, allowing me to move on to the small claims court, or do I have to wait until they've 'looked into it'?

    Ignore them! They are just trying to frighten you off! Follow Martin's advice and don't let them put you off claiming YOUR money back.

  • Good evening everyone.

    I would just like to say a massive thank you to everyone who has helped me on my journey of reclaiming bank charges.

    I have just looked at my acount and there was a deposit on there from this morning crediting the whole amount which was placed.

    To be honest my claim was strung out longer than other's I have seen on here but it didn't stop me from getting what was mine.

    I first started my claim in early September of 2006, and explored every letter and way of getting the bank to pay up. Light was finally seen through the tunnel when the court declared me the winner without an appearance stating that the defendant hadn't sent any evidence or statements backing their defence.

    So, this is basically placed here for people that are thinking "should I shouldn't I"and my advice is YES you should, ok, It's maybe a little daunting to start with and there were times when I was slightly worried about a court appearance but that never occured (the court favoured me a few days before the deadline). All i can say is that if I can do it then anyone can and I truly mean that. everyone is so helpful and the documents found on this sight are great" so please don't give up the fight.

    Thank you each and everyone of you that helped me.

    Total reclaimed

    £1305.83.

I am still finding the bank is taking costs from me even after I have reclaimed my money. How do I go about this. Do I simply make a phone call and hope they acknowledge this straight away or do I go through the whole process again. Many thanks. Family life.

    I found this letter on a previous post, hope this helps.


    It has been noted that you are still applying eroneous charges to my account.
    Please be advised that I do not accept such penalty charges which I believe
    are not proportional to your costs.

    If you believe they are proportional to your costs, please advise me in writing
    giving me a full breakdown as to how you have arrived at these penalty charges

    In the meantime, I do not accept such penalty charges particularly as in Common Law
    they are unenforceable. I expect these charges to be refunded immediately

    Please acknowledge this letter
