i have now recived papers from court along with abbeys defence.
what should i do next please any help or advice needed apreciated ty
or do i send in the bailiffs? or carry on with court please help

You can only claim OD interest charges if you can prove that they were caused purely by bank charges and not normal over spending so if you are proceeding to court action you need to make sure your claim is correct as the bank will most certainly check your claim.

A quick question if i may, i am currently going to court with Abbey the amount i quoted was 4131 without interest now i am going to court can i add that on. I am not sure when i filed the mcol if i said i wasnt claiming interest would this matter.

You need to wait until you hear from the court with a date for your case and possibly the Allocation Questionnaire to fill in.0 -
am ready to fill in mcol but have a couple of questions first I followed all the rules and asked for my money back sent two 14day letters with no reply
when I got my statements letter dated 27/04/07 at the bottom it says
*please send any remaining statements prior to 1st september 2001
I have never received these but keep getting statements from saving account
so
I have received statements (well print outs from 01/08/02
and this is how I have worked my claim out.
I want to know can I take the amount I am claiming from 01/10/02
which is £1038.86 (including interest) and divert it up to estimate the
rest of charges my first letter was sent 14/03/07 which I assume it
the date of my claim.
charges are for 54 months can I divert that by charges and x 72 which gives me
1384.56
I hope you understand what I am getting at and can help me since lloyds
are not going to send me the rest of statements once I have started my claim
It sounds like you are thinking about estimating some of your charges which is not a good idea as you will have no prove of these charges and the amount when or if you get to court.
Insist you get the statements or as you are with Lloyds you can get them online.0 -

was wondering if anyone can help please?????
i filed my claim against halifax with mcol on 17th april,it was served 23rd april,halifax acknowledged on 2nd may and now have 28 days to defend,anyway received a letter yesterday saying they were sorry that im unhappy,and that i agreed to the charges when opening the account blah blah blah,and that they have declined my complaint? and if i still remained unhappy to refer my concerns to the financial ombudsman service!!!
so am i being fobbed off again? or should i just wait and see if they defend by 30th may? confused by all this as every other post ive read the banks are paying out,getting abit disheartened by it all now as feel i will lose.
any advice on this and what to do would be greatly appreciated

I was wondering if someone could point me in the right direction......
I am claiming from Barclays on behalf of my boyfriend. I sent them a letter asking for over £2,000, and recieved no reply. So i sent them a letter saying I was going to take them to court. They then responded with a partial (and quite pathectic!) offer. Do i need to send them a letter saying thanks but no thanks for the partial offer, or do i carry straight on with court proceedings within my time scale? My boyfriends under the impression that there's a template out there to send saying we'll accept the partial offer but will carry on with court proceedings for the rest. But how Barclays have played us so far, I don't think they'll pay up their partial offer if they see we're taking them to court for the rest!!
Any advice would be greatly appreciated!!!

I am with lloyds on line banking but can only get back to sep02 the same as
I have been sent. I sent a lba twice with no reply. Shall I resend asking for
outstanding statements, stating dpa or bring action and treat the outstanding
statements as a different claim?0
