Just received a response to my first claim letter this morning for £1300 on my credit card. They have issued me with the standard 'it's all in the terms and conditions' nonsense letter. I am sending my court threatening letter tomorrow (hope they cave in because I don't have enough cash to take them to court). From what I've heard they may do.

Hi,
I am claiming back bank charges for Mum and Dad. They asked the woolwich for the charges over the last 6 years and they sent statements dating to 1999 so we have asked for the amount from then until now. Recently recieved a letter from the Woolwich stating that they were not going to refund any of my charges.
I therefore wish to take them to court and have some questions in regards to the moneyclaim website.
1) Particulars of claim.
Is there a template for this section? I have no Idea on what to write.
2) Do I need to keep any documents? Some websites say to print copies, is this of the claim?
3) What happens when I press the submit button? Do I need to pay the court fee straight away?

Well, i have'nt heard anything from the HSBC concerning my claim for
£3666.68! So I am just off to the post office to send off my next letter threatening court. So we will see if they ignore that or make an offer.
I have also sent Barclays asking for a list of charges over the last 6 years.
Within a couple of days they were on the phone, saying they could'nt send me a list of charges but would be happy to send me copies of all my bank statements and they would be with me in a couple of weeks. (Sounds promising...)

Certain kinds of accounts charge a nominal amount each month to keep open. This kind of charge cannot be reclaimed. It is not counted as a charge, it is more a service fee for the account.How many surrealists does it take to change a lightbulb?

2) It's your choice whether you print out a copy of your court claim. It will be online for you to login and look at whenever you like, so this isn't needed.

I have recently sent Halifax a letter requesting my bank charges of £217 back. I sent this letter to my branch.
I have received a letter back from the assisstant manager telling me to call customer services.
Shall I call them - will they be able to help??0 -
Will you be able to haggle with them if you phone as that could be what they want, or worst case senario they might say you aren't keeping your account as well as you should?0

Just a general question to guage opinion....
With some District Judges striking out the Defence (banks) case on the grounds that the banks are abusing the Court system by settling virtually all claims before any actual hearing, would it be worth mentioning this on the particulars of claim or AQ???
I may do some research at my local County Court to see what the figures are surrounding these kind of cases, i.e. how many are settled before hearing. Would be interesting to see
