I feel awfully unthoughtful in telling you that I have managed to request Judgement when a lot of people have not been this lucky (I'm not completely lucky, took another one of my Lloyds accounts to court and they've just defended it stating that I requested over 6 years' worth of charges. Funny that considering I onlyopened the account in 2003.....) but just wanted to know how long it usually takes to receive monies from here. My Judgement is being checked for validation (requested it today) but not sure what to do now.
Want my monies but love the prospect of calling in the bailiffs.....
Anyone have to wait long for their monies?
Please advise me, since posting this last, I am now able to request a warrant upon non-receipt of payment. How long should I give Lloyds? I only requested Judgement yesterday so it's only been 1 day.
Any help would be greatly appreciated!0 -

I have just received from the court the defence from barclays bank to my claim. In it they say that the charges are lawful, and that I am trying to reclaim more than 6 yrs charges. This is obvious because of the lenght of time it's taken from the time I started my claim back in January.
Has anyone else had details of their banks defence to their claim, and is this just the normal response from the banks to the courts0 -
hi there new to all this just want some advice please.
i successfully reclaimed £1700 from my natwest bank account now looking to claim charges back from my now closed natwest credit card account but a bit worried if i do so will this affect my bank account as i still use it.
plus when i settled my claim i signed an agreement not to try and reclaim my charges again from my account or my account will be reviewedor closed.

If you have received nothing after 40 days write to advise you will be reporting them to the Information Commissioner for the breach of your entitlement under the Data Protection Act to receive your data within the statutory time limit of 40 days. It may hurry them up a bit and if not you should report them. This is the most common problem initially with reclaiming and there are thousands of complaints being dealt with of this nature on a daily basis by the commissioner. Good luck getting your info0 -

Technically the credit card is a different account with no such agreement not to reclaim charges on so you are perfectly entitled to claim on this account. Dont sign anything this time to say you will accept future charges. They dont have the right to ask to you to and know perfectly well they shouldnt be charging disproportionately high fees in the first place.0 -

I think this is entirely up to you and once the bank have been informed of judgement they are obliged to pay promptly. I'd ring the court and enquire as to when exactly the bank will have been informed and count from then. Personally I should think 7 - 10 working days afterwards is plenty of time and would write advising them of your intentions to allow some time to pay and that you will take further recovery action should they fail to do so within the allotted time. The ball is in your court basically on this one.0 -
I'm counting down the days until hopefully HSBC claim does go to court. I would just like to have my say to somebody(judge) who is listening. Money owed to bank is only because of bank charges and because they did not honour the repayment protection insurance with a loan taken out with HSBC. In one week they tried to take out repayment (which would go into HSBC) 3 times - thus 3 lots of charges - then charging £125 charge for the charges. (this is noted on the statement). Going to speak to the branch manager on many occasions did not help, I was put in touch with money management person who stated that until I could pay my loan they could not help me. It was their fault I got into this mess - they smiled and promised me the world, sold me the loan, then washed their hands of me when I became redundant. I thought buying the payment protection was meant for circumstances like this. I did not get overdrawn until this point - which shows on my statements. Took 6 months to get £860.00 overdrawn. HSBC closed my account and the loan went to Metropolitan. I am now struggling to pay £15.00 per week (still this is better than £25.00 per week to the bank). I would like to have to face a member of HSBC and see if they have any morals.0

Hi Peggy
When we went to small claims court a few years ago to claim from a non-paying customer we went into a small room with a judge and the person we were claiming from sitting at a table the judge found in our favour and ordered the guy to pay within 7 days including our costs.
So, unless it's changed it's just a small meeting (takes about 15 - 30 mins) and if the bank don't show up it will be just you and the judge.
It's your money and they took it from you so go for it girl.
