    With regard to A & B I would ring the bank back and find out and get them to put that advice in writing. With regard to C I dont know sorry. Good luck getting your money soon though and read carefully any conditions of settlement before accepting :)

    Hi sent a letter last week to 3 banks requesting statements over the last 6 year.

    How long on average do they take before they respond to your letter?

    Also, since having these bank accounts i have married, so my name and address have changed but i have made a note of this in the letter i sent out, and have included my previous name and address...i hope this doesn't delay the process even more!!

    Any feedback will be much appreciated...

    Hi i just received my late or missed payment copies from Birmingham Midshires, my mortgage, on looking at them i have seen a lot of £35,£40,£50 Capitalisation fees what are these for are they just what they have added on from my late fees?
    Who i'm taking on
    RFS Ltd asked for £835.43 paid out £?

    Citi Cards paid out £960, Halifax Cards paid out £200 Woolwich paid out £1000, Abbey paid out £3223, Ulster Bank paid out £4675, Sterling Credit paid out £100, Studio Cards paid out £264,Birmingham Midshires paid out £960.

    Do i send my first letter to the halifax i opened my account with or do i send it to a head office somewhere else?

    Also with this barrister guy taking the banks to court over these charges will this affect the outcome of excisting claims?

    As has been said previously the Abbey will dig their heels in, and I have been given the ultimate runaround and eventually was passed on to Complaints at the Chairmans Office which is above the normal Complaints department.

    The lady I spoke to there openly admitted that I had been misinformed by reading the notes regarding my phone calls to them. She then offered to look at my claim and today again refused to repay any of the Charges applied on my account.... I have now given the Abbey ample opportunity to negotiate, to which they have been extremely stubborn and have made a claim through moneyclaim on their website. I think it is best to go to the Court stage first and await the process where the Abbey are concerned, I spent up to two hours yesterday paying for the calls myself except for a quick return call when she offered to look at my complaint. I now await their response to see whether they will purse to a hearing..... Will let u know how I get on....

    A Capitalisation Fee is where they have added arrears to the mortgage term instead of you paying an arrangement to clear them seperately to the monthly mortgage payment. I suppose they could be challenged but they may be classed as service fees rather than penalties. If you havent asked for arrears to be 'Capitalised' on the mortgage then query what they are for.

    Help....

    I started my claim on MCOL, after following all Martins advice.
    I recieved by post a "notce of Issue" this stated dates of
    sent to defendant on 23rd March
    Deemed served on 28th March
    defendent to reply 14 days, being 11th April
    Bang on 11th April the defendent Acknowledged, giving them another 14 days.

    So my Question is, Becuase it says on the issue of notice, that the defendant has UNTIL 11th April, is 14 days after that the 25th April (today), do i have to wait until midnight tonight to send judgement????

    As yet i have recieved no responce.

    My claim is against Natwest for £3500...

    You can send the first letter requesting all your details to your local branch. You can hand it in and get a receipt and then there is no doubt as to when they received the request and you can count your 40 days to receive them from that day.

    As regards the Natwest case it isnt likely to cause any negative effect on simply reclaiming bank charges. This guy is reclaiming exemplary damages on top of his charges and this makes it a little more and different type of claim to what we are all doing here. They offered to settle his bank charges in full and it is the exemplary damages that are subject to further investigation at present.

    Hi mmcourt, have you asked for your list of charges on the 16th April from the Ulster Bank or did you already have them? I now have my letter of complaint made out for the Information Commissioners Office about the Ulster Bank Ltd, I will post it on Monday 30th April.
